一般来说，law分为两种
最基本的common law和civil law
civil law起源于罗马，common law就是大英帝国的重要遗产
基本上前英殖民地实行的都是common law
包括英国，加拿大，澳大利亚，新西兰，香港以及最重要的一个美国
civil law则基本适用于其它国家，比如法国，德国，日本，中国etc.
common law相对于civil law最重要的区别就在于没有civil code
也就是没有法典，不像civil law那样，事无巨细，什么都写上去
事实上的法律条款只有区区几条，具体到每个案例
需要的参照之前的案例予以决定
重大案件，比如刑事案件，则基本上需要用到陪审团
陪审团机制本身并不是common law的专利，civil law同样有陪审团
但是在使用次数上，common law法制下的案件审理明显要多得多多得多
司法各个职能部门分工如下
原则上分为两个部分
地区检察官和警察，看过law&order的人应该都知道
每集片头的开场白就是告诉你有这两个部门
警察按照级别高低分为普通的警察和侦探detective

个人觉得关键是fix the corporate
以前技术不发达，资本家必须拼命压榨才能有利润。更人性化更民主的企业制度被实践
之后发现，一部分被激励的人多创造的财富不足以抵消另一部分怠工者少创作的财富，
因为劳动效率之间的差别并不大，而被激励的人少于怠工的人。
比如说一般工人的效率是100，特别优秀的可能是200，怠工的可能是50。这样只要被激
励的人少于怠工的人的一半的时候，资本家就会亏损。这样就意味着宁可不激励优秀的
那群，也要强制怠工的。
现在的技术工作，特别优秀的可能是1000或者10000，怠工的可能是0。The game has
changed. 只要被激励的人达到怠工的人的1/100就可以平衡了。
推荐一本书叫 drive，讲what motivates people and why motived people is
valuable, more valuable than you might have thought

to internalize something is to incorporate something (the cultural values,
mores, motives, etc., of another or of a group), as through learning,
socialization, or identification.
But emotion is not cultural values, mores, motives, therefore cannot be
internalized。

Zootopia was the most in your face mind control I have seen. The Utopian

现在建所谓的“毛对撞机”就是忽悠中国人往一个几乎死掉的项目里砸钱。
LHC上面什么都没有发现，超对称已经大半截入土了。
当然过去40年2代理论物理学家忙了一辈子的东西也不甘心就这么挂了，这帮人的想法
就是，10GeV没有发现超对称就搞100GeV的加速器找，100GeV的没有再搞个TeV的加速器
继续，还是没又继续搞了个巨大的10TeV级的加速器，这就是LHC，LHC除了发现标准模
型确实无懈可击之外什么都没有发现，接下来这帮人开始继续忽悠，咋们再来个100TeV
的吧。。。然后取了个很拉风的名字--毛对撞机，估计老毛在这帮年纪大的欧美知识分
子心里还有些分量。
建10TeV的LHC还可以说有很强的理论motivation，现在再搞100TeV的motivation就已经
很勉强了，这种就是赌徒式的科研---“也许说不定100TeV的物理会有点什么不一样呢
”，为了这么一个概率很小很小的赌局往里面砸几百亿美元的建造成本以及后续的无数
运行经费，根本不是中国该做的事。
现在比较有发展空间的是宇宙学和天体物理实验，加速器实验已经进入死胡同了。 |
