一点torts，刑法，civil procedure等等知识来浅谈，不免贻笑大方了。我觉得如果要
求金钱赔偿，必然有一个证明赔偿金额合理性的问题。除非是壹块钱这样的norminal
damage （也是可以的选择），一般的damage金额（如1百万）要能被批准除非原告能证
明有物理损伤的精神损失，然后根据具体多少损失来估计赔偿金额，或者能以强有力的
证据证明abc或kimmel违法，法官愿意给punitive damage. 我这只是自己的想当然，没
有做过更多研究。不过我还是觉得证明金额合理性是很难的，除非将来有受这次事件教
唆的对华人华裔的人身伤害，我觉的要取胜很困难，punitive damage 很难。不需要伤
害结果的罪行可能有，但应该不会这么容易取胜。考虑到可能会变成class action，法
庭未必会同意给任何一个原告具体金额赔偿（因为那样所有原告都应该同样赔偿）。

什么是直接，比如我们宝宝的血糖42小时没有被监视，这个是negligence，但是是否必
然导致肝损伤？不直接，因为很多医生会说没事。
但是如果有诊断是代谢病，这种病人会出事。所以这个最关键的地方任何一个医生都不
说，好心的医生只是说可能是脂肪酸代谢，同时说不是这个，不是那个。。。 是这个
病谁也不说。绕着走。
其实就算有医生说，普通律师还是不会接。我们其实收集到的资料已经完全足够了，超
过了第一次找律师的要求，，， 问题是律师们要求越来越多。。 我们认为这个涉及到
种族因素。他们考虑陪审团是否会同情我们，。。。
如果法官说医生故意干坏事跟本案无明显关系，我们肯定很难打赢。因为我们自己也没
有怪疏忽护士的责任，谁不会犯错误呢？让人背心凉飕飕的是医生故意伤害病人，掩盖
病情不救治让继续恶化等病人死。。。 可怕。而且就我们宝宝的经历发现大多数医院
都这样，我们自己有自己的统计数据。

makes it almost impossible to bring a firearm during a trip mostly on
airplanes. This is a sad story to both victim's family and Chicago taxpayers
. The core issue in my opinion is the negligence of involved cops. Some
people in charge of this negligence should be punished. I hope there will be
a criminal investigation together with this settlement.

医院采购的时候当然希望能够减少护士的负担增加她们的生产力，所以尽量买好的贵的
。尽管贵并不一定最后增加了到病人的康复上。
同时医院也要力图证明他们在采购的时候没有negligence。否则将来诉讼的时候别人问
到，你为什么明明有贵的好的，为什么你不买，而买这种便宜的针头。买了贵的至少在
诉讼中对negligence的证明显得道德上很强大。 |
