数就不算full time，可能我记错了。这个我再问问系里。
还想问问关于因为不可抗力造成I20没有及时renew的理由。客观上是我自身原因造成的
。但如果就这么说明上去，移民局是不是肯定不会批reinstatement？ 就是说一定要找
一个借口，是学校耽误了，而且要学校出具证明？ |

期， 和学校失去联络，学校就把我的I20给停了，我回到学校又生了病，结果大概F1失
效两三个月才开始办reinsatement并获得批准，然后完成学位，并找到了工作和H1B。
现在我打算回中国一趟，正在填DS表，根据我的情况 DS表里“Have you ever been
unlawfully present, overstayed the amount of time granted by an immigration
official or otherwise violated the terms of a U.S. visa? ” 这一项应该怎么填
呢？ 我的F1 reinstatement会对签H1B有影响吗。

有在A学校注册课程.后来5月份拿到B学校的TA.于是申请转学,但A学校说我没有注册过一

请F1 reinsatement.为了这份TA,我最终选择了做F1 reinstatement.6月份寄出申请材料,
到当地的USCIS地区办公室.可是由于银行不接受我的支票,又把我的材料退回来,白白耽误
了一个月.7月19将支票换成money order, 直接将材料送到了地区办公室.终于在开学的前
一天得到了批准的通知.感觉申请过程中要让学校给地区办公室的 Student officer打电
话,可能会有很大的用处. |

在填I539的时候，里面有一个问题：3g. "Have you or any person included in this
benefit request been employed in the United States since your or his or her
last entry into the United States or the date of his or her last grant of
an extension or change of status?" 我之前在学校做过TA，那是不是要填Yes呢？
这个问题在USCIS的ELIS里面是和犯罪之类的问题放在一起的，所以有点疑惑。她说的
employment是指full time的还是学校的TA也算呢？

renew your H1 within US, otherwise, as what I was told or what I understand,
officially there's no way to go from AOS to H1 within US, as AOS is an
immigrant status, but H1 is a non-immigrant status. You'd have to go to a
third country to apply for H1 visa stamp. That would be the case for the
people who have used their EADs, that's a hard AOS status.

前的F1/F2身份就会失效。
但是要想保留H1B名额，就一定要10月1让h1b生效。没生效的H1B revoke后以后申请还
要抽签。

说你这个, 我连漫天要价的语言学校因为不写作业不考试被涨学费而且只能转入转不出
, 一周20hrs少一个小时都给留电话语音要挟报告移民局被deportation啥得都有, 最后
被语言学校terminate i-20都见过, 不过遭遇黑店也算是reinstate不可抗拒原因了倒
是.
语言学校就是个挣黑心钱的机构, 你百依百顺只能是被疟~去移民局网站上把f1
transfer得那20页的terms多看几遍, 心里有个bottom line, 不要听语言学校忽悠人,
先靠他们维持着, 如果中途碰上黑店了或者经济上影响衣食住行了再说, 不能说冬天
没吃没住交不起手机月票一边维持身份一边喝北风把. 5个月内你有offer在手里再去想
reinstate的事情. reinstate对非移民性签证的影响不是很大, 但你只能搞一次,毕竟
不是游戏, 但也并非你想象的复杂. reinstate的时候找个律师多请教, 条款是很灵活
的, 说只有学校的mistake才能reinstate得肯定都是听别人说自己没搞过的. |

本科生，13年秋天少没有达到每学期最少需要修的学分，14年暑假学校才发现，当时通
过学校提交了f1 reinstatement的申请，说课程太难了，所以drop。现在收到RFE,认为
是"明知故犯"。大家看一下，以下方案哪个更好点？
1.withdraw f1 reinstatement的申请，马上回国申请签证。风险是这个有可能拿不到
签证，这个学期正在修的课也有问题。
2.不withdraw f1 reinstatement的申请，马上回国申请签证。
3.不withdraw f1 reinstatement的申请。回复RFE,如果被reject,马上回国申请签证。
另外我还有几个问题：
1.回国面签拿签证的把握大吗？
2.out of status是从13年秋天开始算，还是从14年暑假发现这个问题开始算？根据网
上的信息，out of status超过5个月，是不能reinstate的。
3.在美国找律师有用吗？

insurance，我说我只有手机里面电子档的insurance，他看都没看就说，I cannot
take it。过了会还我驾照和registration，递给我一张纸，说是conditional ticket
，只要我1个月内修好前灯，向法院交了发票，照片等证明就没事。
之后我立马照做了，8月下旬就修好前灯并寄走证明材料和ticket。可没想到9月29收到
我们这车辆管理局(BMV)寄来的notice of suspension，说我因没有证明有开车的
financial responsibility，驾照将于10月5日吊销。一看信件日期，是9月15日开的，
9月17日寄出，9月21日收到，不过我有一个礼拜不在家，所以9月29日才看到。
9月30日我赶紧联系法院，碰到个小兵，说那警察其实给我开了两张ticket，只不过在
一张纸上。关于车灯那张，已经dismiss了，给你寄notice of suspension，是因为我

目前开始准备reinstatement的application。上网查了一下，发现有几个类似的案例，
有的学校没有让申请reinstatement就给recover身份了。不知道自己学校是否有机会通
融。申请这个reinstatement居然要有三万多刀的存款证明。。。
求Bless，希望能有别的途径解决这个问题。好伤心。
懂这个的同学能否给指导一下或分享一下有没有别的解决办法。
