先是 We ordered your new card
然后一分钟后变成 We reopened your Form I-485, Application to Register

再之后一小时又收到邮件说状态变成 Post Decision Activity，we reopened your
Form I-485, Application to Register Permanent Residence or to Adjust Status,

发帖数: 41 | 2 刚收到信，140悲剧了，原因是ability to pay: 雇主2014 net income 低于
prevailing wage,我的工资也没有达到prevailing wage,公司资产也不够prevailing
wage.
律师曾经和我说只要我的工资加上公司net income大于prevailing wage就可以（所谓
的“hybrid test”），可事实证明这个hybrid应该不是个law，移民官不一定非要依据
它来判决。其实我的雇主很好说话，只是律师坚持说不用那么多net income。。。
现在有3条路：appeal，reopen，refile
雇主愿意帮我立刻file2015税表，使得2015net income大于prevailing wage。但是因
为ability to pay要求从perm PD （2014.8月）的那天起就要达到，所以2014net
income低还是个大问题。
想请教各位朋友，有没有推荐的洛杉矶做移民audited financial statement 有经验的

我们家副申请人就是这样，当时把我们高兴的
后来没几天就case reopen
然后说要RFE
然后说RFE投递不成功
nm 我们从来没改过地址 律师说既然说投递不成功 那我们就把地址改回现在的地址
然后说地址更改成功
然后没有下文
nm我强烈怀疑 USCIS把别人的case弄我们副申请人身上了 不仅让我们白高兴一场 估
计真正的批准的case 也是等的心急如焚.....
我记得曾经在版上见过类似的情况。当时也有人说，不current 会有问题，但不知道咨
询那位楼主最后怎么处理的。

发帖数: 3509 | 4 立即重交新的485，不要纠结了。你之前的那个485并没有被实际处理，就算被你reopen
成功，也节省不了时间，不会因为RD早而帮你加快处理。485并不是严格按RD FIFO的，
完全没必要纠结receipt时间。
移民局close你之前那个485理由是充分的，16年5月用错表格也不是移民局的错，让不
让你reopen都没有问题。鉴于上面说的，不值得去纠结。早日递交新485早日开始处理
才是王道。 |

还有一种选择就是等到再次C了去联系，这样至少reopen->再次approve 应该会快？但
是有个问题就是在此期间如果用绿卡回国了或者换工作了该怎么算？会不会影响再次
approve呢？
: 一般排期不C的批了， 我的建议都是赶快联系。。。当然结果就是退卡， case
reopen

直没用的蓝牙音响，和LG一起在卧室一角听那些早已不流行的歌曲。。过去一年的委屈
、彷徨随着音符好像立马烟消云散。
一直幸运于刚毕业进公司就办了绿卡，perm, I140一路顺利。也没有换工作。毫无顾虑
地拿着EAD/AP卡回国，却怎么都不会想到485被拒这种极小概率事件会发生在我自己身
上。。

2016年03月左右，在并不current的情况下收到RFE， 内容是要求verify每次工作的合
法性和medical表里的一点小错误。 我在校期间有两个校内兼职，20周以内，期间有一
个校外的CPT工作，毕业后有OPT，直至H1B 生效。自认为完全无误， CPT 和OPT 都有
I20的证明，之后全职工作也有H1B. 没有时间上的gap。就再次把这些文件都再交了一
遍。原来的医生不再list上了，所以medical只好找新的医生重新做了一次。

按照我的经验，应该两条路一起走。一是motion，希望能够reopen。我后来照得的律师
在询问我情况后，帮我reopen了。大概等了约3个月。二是立刻想办法保留在美的合法
身份。如转h1b,h4等。
总之，找个好律师是首要之选。
被莫名其妙deny那段时间，很郁闷。希望这个经验能够给同胞们一点参考。 |

早上七点多到 大厅人已经很多了但我没有等 面试官带我到他的office 宣誓完毕 首先
要护照和ID 然后问了姓名出生日期工作地点等等基本问题 然后问了是否在读书时期工
作过 然后挑选着问了十几二十个yes no问题 然后是目前和以前工作的具体内容 目前
工作证明 然后要了i94、入境签证等 最后一个小插曲：出生证上是我的曾用名 但我没
有准备改名记录 签证馆坚持要书面记录 所以我出了office 回家准备了材料 又去了一
趟 交给他后 我在大厅等 过了一段时间他出来说ok了你先回去 我问有decision吗 说
等两周有结果 会发信通知你 面试结束
我这个面试官比较严肃认真不苟言笑。在我材料上贴了十几个sticker。我看其他面试
官都笑容满面的。
很奇怪的是昨天收到第一个case status通知：Your case was reopened。吓我一跳，
以为是被deny后motion to reopen。紧接着没几个小时说we approved your 485...然

I would say none of pass or double/2S reopening is wrong.
I would also pass the first round, but for the second round, I may
pass for rubber/team play, but definitely bid 2S or double for duplicate
games.

1．Texas期望优先日期排到的I-140 及I-485申请能在4个月内完成(虽然目前Texas仍有
一些2007年7月的NIW还没审完)。Texas真正的期望是除了因为Security及文件不足的案
件外，能90天内审理结束I-140 及I-485的申请。
2．如果I-485已经申请超过180天，公司取消了I-140，Texas不会马上否决I-485，而会
发出RFE(其它Service Center往往会马上否决I-485，然后申请人还要上诉或Motion to
Reopen.)
3．虽然RFE只有30天的时间回答，一般Texas都会再等15天才会处理RFE。如果时间还是
不够，申请人要以书面要求延长RFE的回答时间。
4．如果Texas否决了I-140，也不会马上否决I-485。Texas会等30天，看看申请人会不
会上诉或Motion to Reopen，一旦申请人提出上诉，I-485便不会被否决。
5．Texas对于I-140 及I-485的申请，除非是有Security 或Fraud的问题， |

警局里面的警察除了黑人基本都非常礼貌和耐心，到了法院的看守所就完全不一样了，
这里执行的警察全部是Correction Department的，素质非常低，毫不夸张地说，一半
以上Correction Officer跟holding cell里面被抓起来的人看起来一个德行，他们在外
面聊天满嘴都是脏话。
刚来的时候，先通过medical evaluation，如果有medical condition特别是mental
condition的话就会被转到一个更森严的地方，而且会有一个一周的holding，然后才排
期上庭。通过了这个medical evaluation，被送到一个central holding cell，里面大
