各位老大，请教一个关于两年约束的问题，
我目前人在德国，有两位在这里的师兄最近
都拿到了去US博后的J1签证，有意思的是
他们两个人的签证上都写着:
Bearer is not subject to section 212(E).
Two year rule does not apply.
这样是不是意味着他们这样的J1就不需要豁免了?
小弟也在考虑申请US博后，所以比较关心，这两位
师兄都是拿中国护照，还有一个是首次赴美，
请知道的各位老大给一个回复，非常感谢的！ |

（1）Rule 14是用来对付委员会hold的
（2）Cloture是用来对付filibuster的
也就是说有两种武器对付割老。
是不是毛人弟弟的解释有点跨越 - 把RULE XIV 和CLOTURE两件事情合并简化了。
费了我半天劲，这个是我的理解：
14条有点滑稽，就说一条法案一般在参院要被交到一个委员会讨论，但是如果担心这个
委员会存心不让它过拖延的话（就是根本不让它有机会被参院全体投票），那么可以用
14条来避开委员会。这个布骤极其简单，就是前面贴出来的例子那样，参院多数派领导
要求读一次，然后马上要求读第二次，紧接着自己有说我反对，因为没有反对的话这个
法案就要被提交到相关的委员会了。但是14条规定，在要求读第二次的时候只要有人反
对，这个法案就立即被加到第二天的议程上，不需要交到任何委员会。当然好象这件事
情只是参院多数派领导才能/愿意做。
但是好象14条没有说到16个参议员签名什么的。那个(Cloture)是为了对付另外一个反
对这个法案
的办法 - 拖延法。就是说即使这个法案上了议程，它在表决之前还是要在参院讨论

作了第2年才开始忙绿卡的事，所以H1B超过6年没拿到卡的应该不是个例，这个给家属
一些方便，可以早点就业，或者就业的时候，少一些限制。
至于什么烙印，ICC什么，我不懂，但是既然这个卡是给家属的，我猜应该是跟H1B捆绑
的吧，只要H1B申请把好关，就成吧。什么什么假简历，哪里找工作都有假简历，和这
个卡本事有啥关系？
我新来的，不太懂哈，就盼着这个rule可以实行，领导就不用长期呆家里了，否则还要
等2年，不过大家都说这个rule不太乐观。 |

年可以是很多时间段相加吗？还是必须是整段时间（不清楚如何界定）。LD在F1期间假
期回国的时间如果算上，就超过两个月了，如果不算就差几十天。
之前LD顺利办下H1b，本以为应该是满足2 year rule了，但是看到很多人说H1B对这个
审核不严，AOS会很严，有人拿到H1B，但485因为这个被据。
现在非常担心，希望能有个明确答案。律师那边还没有答复。。。

发帖数: 652 | 15 擦，这还用IV内部人士爆料？9,10月份不就是格老给DHS和巴马写了一封措辞严厉的信
，质问他们在偷偷搞的memo都是什么东西，executive branch怎么越权篡改法律嘛。虽
然白宫没有公开回应，但是以格老的地位，他们绝不可能置之不理，肯定是私下联系达
成了协议，删掉了大部分条款。所以这次rule making process开始的时候，格老一点
动静都没有。
至于说什么FBI调查我觉得是扯淡，格老是参议员，监督政府天经地义。如果FBI真的调
查，最多也就是调查memo怎么泄露出来。问题是这是criminal matter吗？我看不像，
所以所谓的FBI调查很可能是说大话。
现在看来，想通过comment对这个rule进行任何改变都是希望渺茫的。这届政府的政治
资源在强行通过DACA和DAPA的时候就已经消耗一空，最后还被联邦法官批准了24个州联
合要求的禁止令，白宫上诉继续被打脸。14年底，奥巴马信誓旦旦要如何如何，现在看
来，唯一的成就就是H4 EAD（其实这个是个不小的成就）。现在能费力把140 不许

* 某队员如果是去年的一轮秀，那么今年不能 keep。
