八年前的这个季节，从国内来到美国。来美前，博士毕业后在一研究所工作了近5年。
期间主持完成了自己的第一个NSFC课题。由于不喜欢那里的小环境，离开那里后到西北
一大学工作。幸运的是，在那里又拿到了第二个NSFC课题，加上省部和学校的资助，支
起了还算小有起色的一摊子。虽然那的科研条件比原单位差一些，但一个人在那干了近
三年的时间，教书、带研究生、作科研，每天忙碌着，干着自己愿意干的事，少了原单
位的勾心斗角，而且在学生面前第一次觉得自己还是个有用之人，所以也很快乐。无奈

letter里有一个clause，大意是"if you accept this settlement, you agree to
waive the right to sue the insured"。这里"insured"就是指你的朋友。所以你朋友
需要搞清楚他的保险公司close的是property damage，还是bodiy injury，是前者的话
如果这个accident还在accident所在州的statute of limit以内，你的保险公司应该负
责，如果是后者的话还是要check保险公司，确保settlement letter里有这个clause。
不过，如果这个accident发生在accident所在州的statute of limit以外，对方应该已

双方的车都报废了。我左腿膝盖内侧有巴掌那么大的一大块淤清并且还有点肿，当时有
一点pain的感觉， 今天不碰它基本上不痛了。胸口在心窝以上的肋骨（有大包子那么
大的一块面积吧）当时有一些pain的感觉，今天似乎好了点， 用手压这块肋骨会有痛
感，不压几乎感觉都到了，不知道这是不是在离心力甩的过程中，这块肋骨被安全带压
到了。副驾上的人身体的右边（肩膀，大腿右侧，屁股）有酸痛的感觉。去了一个大医
院的ER做了一些检查。做了X光胸透，肋骨没有什么问题。也做了膝盖肿的地方， 也没
什么问题。 还做了一个似乎是心电图似的东西，说心脏也没什么问题（因为我说心窝

我留意SPU有一段时间了, 觉得有人在烧它, 就在三块钱左右设了个2块钱的 LIMIT
ORDER. 儿童节那天突然有家投资公司出了份报告, 结果当天就从2.5掉到了1.95. 我
觉得那报告撰写人太不了解中国国情了, 但是为了慎重从事, 在中午决定把量减半. 可
是直到今天上午, ORDER还是没有FILLED, 我直埋怨交易员人品差.
刚才进入帐户一看, 乖乖, 有CONFIRMATION.
问题是,
(1) 这 SETTLEMENT DATE 奇怪啊! 会不会股价回升交易无效,股价下跌SETTLE呢?
(2) 在SETTLEMENT DATE 之前我不能卖那股票吗?

度都在40多mile。双方的车都报废了。我左腿膝盖内侧有巴掌那么大的一大块淤清并且
还有点肿，当时有一点pain的感觉， 今天不碰它基本上不痛了。胸口在心窝以上的肋
骨（有大包子那么大的一块面积吧）当时有一些pain的感觉，今天似乎好了点， 用手
压这块肋骨会有痛感，不压几乎感觉都到了，不知道这是不是在离心力甩的过程中，这
块肋骨被安全带压到了。副驾上的人身体的右边（肩膀，大腿右侧，屁股）有酸痛的感
觉。去了一个大医院的ER做了一些检查。做了X光胸透，肋骨没有什么问题。也做了膝
盖肿的地方， 也没什么问题。 还做了一个似乎是心电图似的东西，说心脏也没什么问
题（因为我说心窝上那一块肋骨有痛感）。还有就是问有没有头晕头痛和dizzy的感觉
什么的。结果就给我们开了止痛药，把我们打发回家了。警察给我police report 时，
说report 上有一个witness 证明我们是绿灯。
身边的好多朋友建议我找一个律师要一些身体和心理上的补偿。 google 了附近的一些

律师， 有些觉得这个案子对他们小不接， 有些律师接电话时非常没有耐心我想问几个
问题， 他们都不想回答，一个劲的催我make appointment 来office 谈， 所以就把这
些也pass了。 找了一个在电话离交谈还可以的， 去了他的office（感觉还是个比较体
面的law firm。看见了有8，9个律师在开圆桌讨论会议呵呵。 但是去了office 以后感
觉没有在电话里热情，进和出他的办公室时， 他坐在椅子上连起身都没有）。问了一
些情况把我的个人信息全记下来哦了。 他交完填一个contingent fee agreement 的委
托书，里面有几点有点concern， 希望有经验的来看看是不是合理。
1）收费问题： 如果赢了，除了他拿1/3外， 还要扣下 expenses of claims and/or
