这个说得有点道理。近个几十年,我族缺少self esteem,不是个人问题。社会和上层
阶级的影响太大。只是有些人被影响得更大,丢掉了本当有的对本族和文化的自重。所
以没必要攻击个人。
看看当权的有钱的,本当是社会的文化的引领者。但是看看干的事,分明就是在教育大
众崇洋媚外,丢掉独立的人格。
不是个人道德问题。但是比一比更贫穷的印度人,移民文化更久远的犹太人,我们这样
的现象为何更duo。再过几十年,后人来看这一段汉族的历史,不知道会有如何的评价
。文化大倒退的时代。

问题如下
1. 公司第一次招international,所以没有办理H1b的经验。公司没有雇lawyer,找了
HR在网上找信息办理。就是网上的checklist信息,employee和employer分别提供一系
列材料申请。
2. 我入行时顶着Engineer Trainee的title,现在半年了,不知道办理H1b用trainee的
title还是换成engineer的title (PS 公司近期财务有问题,改成2周发工资为90天发
工资,没有涨工资的样子,我为了办h1b也不好去说这个涨工资的问题)。
3. 低于所持职位title的最低工资标准H1B当地信息Wage level 1 40%, 这样申请h1b会
不会受阻,公司是小公司50人的样子。
不知道大家有什么好的建议,帮我渡过难关呢? |

但是很多事件,对大人/大娃来说,是 “emotional compromised

意义。

习2个月(汗,offer是6个月,因为要毕业答辩,5月份提前回国了)。8月份开始又以F1
身份来美读博士,现在博士第三年。打算申请waiver掉那闹心的两个月的J1-2yr
restriction.
看了版上置顶的攻略,非常有帮助,可是我的情况又跟博士后的情况不一样(J1
trainee,转F1):
1.关于中国使馆的豁免,是不是只要附上国内的硕士毕业证就可以了?
2.国内单位的同意函件应该提交什么?要国内的学校出具同意书吗?已经过去三四年了
,这个可能比较困难。
3. 还有什么要特别注意的吗?

1) He or she entered the US as a nonresident, and became a resident later on

qualified as "temporarily present in the US" and "only for purpose for
education"? Besides, US tax every citizen and green card holder on the
worldwide income. Also, CA does not conform with tax-treaty. You may receive

再请问楼主一个关于我的问题。我是J1,但2009年是第二年,所以我是Non-resident。
我LD是2009年4月来美国,以J2来的身份,用EAD工作。那么请问2009年J2是属于
nonresident还是resident,因为根据substantial presence test, 他应该是
resident,但这个test还排除了一些人,说J类签证的学生、老师或者trainee不能用这
个test来判断。但是我家LD,是J2,但不是学生、trainee和老师,所以我就不知道他
到底是resident还是nonresident了,如果是resident我们就可以和你们一样联合报税
,这样会多很多refund,所以在此请教你我家LD的身份问题。谢谢 |

我的 DS-2019上写的 exchange visitor category : research scholor
payroll给我的8233 box 6 & 9a 都是 J1 research scholor, 但 box 10 却是
trainee.box 12a is treaty 20(c). box 12b is 5000$. 还有个 statement
for form 8233, 大意说根据中美 treaty 5000块免税。
后来我想,可能是我入境时还没有拿到博士学位,所以把我归到 student或者trainee
了。 现在我有博士证书,是不是应该让他们换title了?
请问这是不是像你说的情况, 谢谢?

payroll说federal tax是因为我w9交上去的时候工资单已经打出来了,下个月就不会扣

07,08,09,10,11我是non resident alien,全奖,一分钱税都没有交,直接exempt
了,拿的是1042-s,上面taxable income都是0。按理说到12年夏天才在美国待满5年,
不过按照substantial presence test,12年我已经算是resident alien了。
12年下半年工作,payroll都是直接扣税的,但是12年上半年学校的奖学金也是一分税
都没扣的(1042-s上面taxable income是0)。12年的奖学金我到底要不要交税呀?该

我觉得我可能搞混了两件事,就是我奖学金不用交税是依据treaty article 20(b) (
如下),所以跟我是不是non resident alient并没有关系,所以即便2012年我是
resident alien,奖学金不交税也是没有问题的。这样子理解对吗?

对于researcher没有定论,我觉得是按照301.6114-1(b)中的(4)(ii)(D)条款,即
treaty上有要求,而申请人符合treaty的要求。
