I may not describe clearly. She went back to China during OPT. So she doesn'
t have I-797. If she is not in USA, is company able to apply H1-B for her?
What her status should be for applying H1-B visa? |

不过H1B里没有这项要求吧，好多印度人直接到美国的icc来工作呢，他们也不是f1啊 |

发帖数: 44 | 6 no. She can't use F1 anymore since the OPT can't be used anymore. Her offer
starting date is October. She can apply H4. But I don't know if there is any
conflict: company apply H1-B in April, she apply H4 after April and she
comes back to USA early than October.

发帖数: 185 | 7 这个有点复杂了，如果她在4月份之前回来的话，还是可以用opt回来的（如果opt没过
期），只要拿着offer letter去就行了。
4月到7月之间，我就不知道了，得问律师
7月到10月之间，可以直接申请H1b visa.
H1b是10月开始生效的 |
