我听同事说，H-1B期间不可以在美国境内使用unpaid leave of absence，只能在境外
（例如回国期间），因为这期间人不在公司payroll上（我觉得应该是说在payroll上不
是active的），H-1B状态是失效的。不知道是不是这样？？谢谢！ |

我跟系主任商量，maternity leave之后整个春季学期都不上班，用unpaid leave of
absence，系主任都已经同意了，可是学校管H1的律师说USCIS可能不会认为这是
regular maternity leave，绿卡律师倒是说没事，只要学校批准并保留我的职位就可
以。
有没有人类似的经验？这个unpaid leave of absence可以被FLMA cover吗？还是说11
月到1月这个就是FMLA，不能再继续休了？对H1和绿卡到底有影响吗？ |

学校说，强调教育不会中断，而去外地转了两个月的。学校这么制定规则是有理由的，
我只是不赞成用“逃避”的说法。把你的理由跟学校说，可以最好，不可以就回来之后
重新入学。比去琢磨一个“逃避”的方法靠谱。
