），3月份奥本还坚持认为自己的判断是对的，6月不退，提到有个原因是缺乏USCIS的
数据支持，4月份（也就是今天）他说他跟AILA所透露的信息，和他在2月和3月说的内
容是一回事，没有变化。又追问他USCIS的更新数据是否拿到了，他说，得到的数据信
息非常有限，会要求USCIS提供每个国家和每个类别的visa数使用情况。
他连数据都没有，也就不会排期后退或者内部U。 |

奥本这个老贼是众人唾弃的一个bottleneck，所谓modernization visa bulletin就是
说正是他的visa bulletin不科学不可靠才导致了二十多万绿卡名额的浪费。USCIS如此
堂而皇之地向国务院泼脏水扣黑锅，都是因为奥本的无能和错误。希望他的新上司此时
此刻对他很不满意，

注意原话是说“It is the AILAs understanding that issues whether family
members should be counted or taken out in per country visa limitations”，也
就是说在算7%国别限额的时候家属不算，但家属还是要算到EB总名额的4万中的。这相
当于把EB2C国别限额提高到14%（假设一个EB2C带一个家属），印度EB2理论上也提高到
14%，但本来印度吃到巨量SO，实际拿到远远超过14%了，所以这个提高对他们没有意义
。反而EB2C能吃到14%，造成EB2I能吃到的SO减少。
EB2 ROW本来7%都hit 不到，改成14%更对他们没有任何影响了，反正对他们就是一直

现在经济全球化。以后会发展到政治全球化，不再是此消彼长的关系。发展眼光看待问
题，我觉得绿卡暂时是很有吸引力的。不过未来的竞争要站得住脚，要不你成为专业有
所长的技术人才要不你成为有钱的企业家。所以不要只盯着个绿卡。绿卡是权宜之计，
不是长久之计。当然，暂时绿卡还是很好必要。 |

Another effective way IMO is to ask EB23ers to contact their lawyers. If
more immigration attorneys are aware of this matter, they might be able to
get AILA involved to speak to TSC leadership. Just a thought. |

我也知道板上过来人怎么操作降级的，就是新提一个eb3 140.
可是我在看AILA关于multiple 140的memo的时候，它给我的印象就是说，唯一能让PERM
180 validity rule例外的就是提交一个amended 140。它并没明确提到可以提交新的
140，第二页的第一行，却又说道while it is no uncommon to file EB-2 and EB-3 I
-140 petitions simultaneously based on the same PERM... 这又给人一种你可以有
两个140的感觉，但是这个memon没在这里多谈，而是转而谈eb3升级到eb2或者eb2到eb3.
我知道yoyo才说过，一旦eb2 140approved，perm就不过期，请问这个在哪里有明确的
条文规定？ |

可能渠道，迫使政府修正其不当做法。但是，迄今日止，尚无所成就。至于问题会否通
