友的询问，我都一一回复了，欢迎大家有疑问继续给我发信。
整个事情的过程非常曲折，这中间多亏了版上很多同学提供的相关信息，帮助我们找解
决问题的办法。另外特别感谢xmujoe同学的帮助，他的case和我的一模一样，我们共同
探讨，不断尝试，最终几乎在同样的时间拿到了OPT，但是都比希望的时间延迟了很多。

发帖数: 947 | 12 我们知道目前无论是PERM或RIR都是180天有效。在以前如果I-140发生了问题，而且结
果是可以很两极的(例如学历或工作经验的认定，以及ability to pay)，我们往往采取
的方式是不理会CIS的RFE或是denial，再马上申请一个新的I-140。但是目前LC有 效期
只 有180天。这个方法可能就用不上了。公司只能硬着把RFE回答清 楚，或是只有上诉
到底。对于一 个有RFE或denial的I-140，我们不能只看单一的问题。例如有人问说I-
140被denial，理由是CIS要求有“success-in-interest” 的证 明。但是公司认为自
己只是换了名字，不该有这个问题。事实上可能并不那么单 纯。我 们最主 要要看公
司的Tax ID是否也换了，而且公司若有重整，这个重整的结构是什么，是否已经改变了
整 个公 司的财 务结 构，所 以CIS所要的“success-in-interest” 的证明，并非全
然没有道理。
对于I-140的申请，问题不外于就是公司的财务资料及申请人的资格。我一 向的建 议

要求的东 西非常具体。另一类则是非常的不具体，只是把法律的要 求写了一 下。
Denial Notices多半都非常的具体，很 难找 出Nebraska有错的地方。而且可 以看的
出很清楚，Nebraska是不 会轻 易接 受非案例的辩词。目前来说不具 体的RFE逐 渐减
少。具体的RFE很 多都盯住申请人某一部分的东西不放。例 如申 请人说他在哪里发表
了论文，或 是有什 么继 续 不断的成 就。Nebraska就要你提 出申请之后还有多少
citation，而 且要你再找人证 明这些研究在后 来又有的影响是什 么。有些时候申请
人把自 己说的太 好，或是这篇论 文太新，一下子没 有太 多的citation，而且也没
有太多人愿意强调其重要的影 响是什 么，反而造 成问题。我们就看到几个这类的
Denial Notice。Nebraska并不看申请人其它的资料，而且只盯住这一 个。对申 请人
来说是不公平的。一般而言，如果其他论文的citation不错，而且还有新东西出来，这

到工卡，10.30面试，11.15被拒,11.20收到信。党员身份截止日是2015.12，在I485表
格的最后一页写了声明，律师也给修改了一下。大体内容就是：入党是在毕业前夕，家
乡有个国企有我专业对口的职位，入党是为了增加得到这份工作的机会。
面试过程中，面试官问到党员问题，回答，是，入党是为了工作需要。在毕业前夕入党
，家乡有个国企有我专业对口的职位，入党是为了增加得到这份工作的机会。这样的回
答也是根据版上的经验常规回复，内容与485上的声明一致，当时面试官也没有继续纠
结这个问题。

好心提醒：没三退的赶快三退。拿到大法三退证明5年后才可以递交i485。配偶是党员
是否有影响就不知道了。
可怜了那些在国内积极上进要求入党，到了美国又积极加入教会的大妈了。
