would know that unpermit condition will discorage seller and impact his
selling power. He suppose to disclose to the buyer in the disclosure at
first place. If he is really innocent, he should check NO in the item that

LIST AGENT卖房的时候，卖家DISCLOSE自己知道的。 而这些信息是在前买家ROOF
INSPECTION REPORT之前。还有你要搞别人“故意”隐瞒，让你损失了，你很难。 ROOF
都摆在那里，有没有遮盖或者不让你看。 你看了，你自己去掉的INSPECTION
CONTINGENCY。所以，你要以这个告别人，你没有机会赢，而且你以这位借口，砍价，
卖家肯定不鸟你。

现在看来daylight贴的也不是referal link，也许她有，但是没贴，只能说搞business
的人要更老道，知道怎么避免普通人根本想不到的麻烦。

seller agent要disclose multiple offer 給buyer一樣，這叫做Good Faith and Fair
Dealing Covenants，只是大部份的seller都選擇不追究，所以才會助長歪風。就賣方
來說，不是說disclose multiple offer就是為了提高價錢，有時會碰到multiple
offer，是最有可能close，不是最高價得標的情況。就買方來說最好的就是在對方接受

“我们也是看到 house inspection后发现地基露在外面的裂了好多大缝这么明显的问
题seller说不知情说不过去吧”。 这个解释上法庭一点用都没有，因为Seller也可以
解释说inspection之后才知道有裂缝有地基问题。你需要solid Evidence来证明Seller
知道地基有问题而故意隐瞒。 举个例子，Seller在N年前做过inspection，inspection
Report说地基有问题，但是Seller没有disclose给你们。
Agent不是Inspector，Agent一般会出一份Agent Visual Inspection。 如果他/她在外
面看到裂缝了，他/她就应该写在这份disclosure上“在那里看到裂缝”。但是Agent不
可能说看到了裂缝，然后就说地基有问题。 因为房子是否有问题是专业的Inspector说
的， 超出了Agent工作的范围。实际操作中，很多地基问题Agent也看不出来，因为

这种情况下该怎么处理。
1). 首先review一下收到的disclosure，特别是Seller Questionnaire。 Double
Check到底Seller有没有disclose这个material facts。
2). 如果没有disclose,但是是第一次漏水（可能性极小），那是你的运气实在太糟。
如果不是第一次漏水， 你需要提供证据Seller知道漏水但是故意没有disclose。 很简
单的证据， 如果是第一漏水， 地毯地下的Subfloor应该还是很新的。 如果经常漏水
， subfloor应该陈旧的水迹，甚至发霉等等。 有证据后让你的Agent通知Listing
Agent， 把证据提供给对方，因为对方故意没有提供漏水这个material fact，让对方
支付维修的费用。 如果对方不理睬，直接找律师发律师函。
不知道你的房子在哪里。具体状况？ 如果水房背后的墙是直接露在外面的， 估计要好

patent is about disclosing the main mechanism of an invention. For software
, that should be the source code, not a flow chart. A software patent
shouldn't be granted without the source code of the software disclosed.
As some one said, most software patents, which are jokes, don't have source
code disclosed. Yes, most of them are just ideas. And these ideas are not
the time consuming part for developing the software at all. |
