不小心到了55. 以后一定小心。
Nature of offense写的是：Failed to obey posted speed limit.罚了100多
开ticket的警察说不会扣点，不会涨保险。
不过我现在有点小疑问。
1.我要是交罚款的话，应该plea guilty 还是 not guilty？
2.支票寄到哪个地址？ ticket上有2个地址，一个是 "address of magisterial
district office", 还有一个是"station address of police office"?

发帖数: 26 | 3 今倒霉透了,在LOCAC开车,西向东2条LANE,东向西过来也2条LANE,在在西向东的外LANE
开,速度都正常我经过一个十字路口以后,发现那边过来和这边过去的中间的安全线那里
中间停了一辆警车.我看了一下我右面内LANE后门没车,因此没打灯就换到内LANE上了.
警察马上追上来,查了一切正常以后说,开了一张类似上法庭的单.上面写着"fair to
obey the traffic control device".然后说我要给法庭打电话问交多少钱等.不听我解
释,就走了.
上面也写了到法庭的具体时间等.我不知道是要打电话问交多少钱,还是我要打电话问啥
时候出现法庭.还有这影响我的未来保险吗?我从来没拿到过罚单.

上庭，不能直接付钱。
还有，那个警察在我罚单上commercial car 和accident involved 两栏都打了yes 的勾，当时根本没有任何accident 发生，我只是被他pulled over. 我也是私人的车。只是他给我罚单后我还没来得及细看他就开走了。这种情况下我应该准备些什么东西跟法官argue, 还是只是嘴上跟法官说明就好了。
这种情况上庭我要准备些什么东西？ 是不是交上庭费和罚款加罚点。看了些帖子但好
像不是很清楚具体流程。有谁有类似经验的请告知。 非常感谢。 |

我不住在oregon，这次是到oregon玩，一直开车很当心，谁想出了这种事。

警察看见你红灯右转弯了吗?警察只能说没看见是别人radio call他的,
这时候你要求那个call的警察出庭作证,现在这个警察什么都没看见,依
法不能作为证人.
然后case就over了,谁吃饱撑的继续再开庭啊,而且radio call的警察真
来了也没法证明自己就是那个人.

警察说虽然你超速了，但是没他写speed然后跟我说写的是light 什么的东西，说比
speeding便宜 lol， 警察叔叔很凶，我虽然看了ticket不知道在写什么，也没敢问清
楚就直接滚了。
各位大大帮我猜猜ticket上写的是什么原因吧，谢谢各位了。

不上庭, 打电话或者上网查都可以得到信息", 结果后来查被告知必须要上庭, 去问
court得到的答复是:"虽然单子上写着不必须上庭, 但是只要是accident就必须上庭"
有几点疑问: (1) 和右边curb的擦撞是否属于上面的这个4分的traffic infraction,
感觉这个是给闯红灯的十分严重 (2) 不管是不是要求, 我是一定想要上庭的, 只是
court给"必须上庭"的要求很不舒服, 这和单子上并不符合啊 (3) 上庭应该注意些什么
呢, 有办法dismiss掉这个ticket吗?

口，单侧2车道，我走在内道，前面有一辆车，当时是红灯，我就排在第二等红灯，那
个灯十分奇怪，左右两侧的红灯灭了又绿，绿了又红，我这个方向始终是红灯，等了差
不多2-3分钟，踩刹车的脚都有点麻木了，我当时就想是不是红灯坏了，身后的车子也
排了一大排。当我看到几个方向都是红灯的时候，手贱，滴了下前车，前车犹豫了一下
，前行半米，立刻从内道急右转（事后，我猜测是他看到了旁边的警车了），我傻乎乎
地慢慢地小心直行通过路口，这时警车杀出来了，我开了20米，在一个停车场停下，警
察说我闯了红灯，我说我以为那个灯坏了，他说没有坏，是好的，然后给我开了“fail
to obey traffic device"罚单，3个月后上法庭。
我回家查了一下，大概需要罚款200，扣3点。不知道我是直接交了钱呢，还是去法院申
诉，像这样被抓现行的，上法院有不被扣点的希望吗？
我感觉也被钓鱼了，那个路口的警察一大堆，深更半夜在那里等着开单子。

它们的心情。
同一个路口白天会给辅路半分钟，夜里就只有两秒。有时候主路路权很多，辅路上待转
车辆排一队；也有主路刚绿车流刚起来，辅路上来一辆车又变红的情况。得随时绷紧踩
刹车的弦。
有时候觉得还是大城市的灯比较有规律，可以预判，国内的还有倒数秒计数。
因为这破灯，晚上黄灯转红灯的时候把车停路中间，刚吃了张fail to obey TCD的单子

没有拍到司机。有一个10秒的video，上网看了也没拍到驾车人。这种情况有可能去
appeal to dismiss吗？
这张Ticket上面没有让你确认是否是驾驶者，只有三个选项：1.交钱；2.Provide
information as to the new owner of the vehicle；3.Request a hearing to

今天晚上和lg出门，刚刚左转，就看见警察跟上来了。急忙停车，警察说我们黄灯的时
候应该停下来，不能开。实际是，我lg开车很谨慎，今天他
确实是绿灯的时候开动的，但是我们在很多车后面，我们在在转弯时刻灯变黄了，但是警察一口咬定我们是在黄灯

的疑问。
信原文我附在下面。这里给个Abstract:
1.限速是严格限速，没有理由可以超速。
2.“follow traffic is safter”的说法不对。要求不能跟着超速的车开。
3.“因为开太慢被追尾是前车责任”的说法不对，这通常说明后车“Fail to Control
Speed”。
美国好，大家都承认。大家也都羡慕他这里法制比较好，大家比较守规矩。然后中国法

保险应该已经赔付了对方。
3月多上庭，因为我之前plea non-guilty
共有4项violations：
1. Fail to obey traffic control device to-wit（这是什么意思啊？有witness？）
2. Changing lanes without giving signal
3. Changing lanes not in safety - accident
4. Failure to notify DPS of change of address within 30 days
当时就是我刚下高速，穿过了不该穿的双白线（于是有violation 1），然后换lane （
于是有violations 2,3），其实我有shoulder check确定后面没车，但是可能因为当时
天色已晚，没有看清，结果被后面的卡车撞倒我的车的右前车门。
问题是我都不记得我又没有穿越双白线（警察到了说我是这样——他怎么知道？我都不
记得了）
还有我记得很清楚，我打了灯的，所以violation 2应该怎样beat？

绿灯时，前面有一辆车也要左传、慢行停顿在十字路口中央，我跟着前移车头压过白线
。路上车很少，我当时觉得前车应该在绿灯时就有机会左拐。
绿灯变黄灯时，前车稍微怔了下、随后顺利左拐，我看左右都没车、也立刻左拐、车到
十字中央时黄灯变红，被紧跟着的校警闪灯栏下。
实在没料到这个路口黄灯时间这么短，前车怔一下就把黄灯时间用了大半。警察在单上
写“failed to obey traffci control device”“cloudy weather, dry road, light
traffic, daylight lighting”,口述解释说我红灯左拐（这跟实情并不完全相符！）
，让我去court.
我有五年驾龄，向来谨慎，之前没有任何不良记录，去年分期付款买的新车，几个月前
上过defensive driving课。
请问，我有没有机会把这个citation清掉？实在不想有记录。

）。我前年和去年各吃了一次。第一次71/45（US hwy，不是高速），第二次86/55（高
速）。警察开罚单后告诉我这个不算speeding，不计点，罚款也少些（好像就是120）
，不影响保险费率。所以就交了不上庭了。
估计这样搞的话大多被罚的人也就选择交钱算了。警察也懒得上庭了。算是薄利多销吧。
不过楼主103/65这个确实超的太过了。。。

上星期天，在宾州speed limit 40 mile 的公路上，吃了一张罚单，110美元，警察在
罚单上Charge 一栏原因为“driver did fail to obey the properly posted sign”.
警察说不用扣点数，也不会影响保险，只交纳罚款，说我当时车速58. 警察说他是使
用Vascar测我的车速。（公路上有两条相距一定距离的白线，警察根据汽车通过这两条
白线的时间来测试车速的）。我觉得我当时是跟着车流在走，车速超过40是肯定的，但
绝对少于58，但是别的车子也肯定超过40的，因为一般情况下，大多数的车子都会超过
” speed limit”.
警察给我罚单时，我当时就不服，我说我是跟着车流走的，我会跟他打官司。那个警察
对我说，如果我打官司，他说它可以改罚单，就会要给我罚点？这是不是算恐吓啊？只
怪我没法录音。

边一条路开出来了。没看到右拐上这条路有一条斜线拐还有一条
90度拐。我走的是90度的，没看见那条斜线拐。然后就被一个
骑摩托的条子抓了，说是拐弯时应该走斜线，给的TICKET是 not obey traffic signal.
请问这个情况在庭上 plead not guilty 有可能胜诉吗？
如果败了，是不是比PLEAD GUILTY的话罚钱更多？
