从大陪审团的报告中可以看出，McQueary向Paterno汇报了看到的情况，
但Paterno向上汇报的时候，却轻描淡写，而且没有参加Curley、
Schultz和McQueary的会面。考虑到当时Sandusky在球队中的地位，
他不参加这个会议似乎有些说不通。
这个报告中说，McQueary对Curley和Schultz讲了他所见到的，但
两个人却说他们听到只是关于Sandusky的不检点行为。
Curley和Schultz向Spanier汇报的时候，也是说行为不检点。
McQueary在Sandusky“被退休”之后，就得到了Penn State的一个

最新消息，PATERNOS等告NCAA和PSU的官司今天取得重大进展，法院发布了长达39页的
阶段性判决书，NCAA提出的10项请求，被否定了7项，肯定了3项。简单总结是：今天的
判决是PATERNOS等原告的重大胜利，判决的最关键一点是：PATERNOS有资格质疑
CONSENT DECREE。
详细情况如下：
- 本官司的原告是PATERNO家，以及4名我狮BOARD成员、4名教授、以前的球员和教练。
被告是NCAA和PSU。
- NCAA在被告了以后，向法院提交了10条OBJECTION，其中最重要的一条就是认为
CONSENT DECREE是NCAA和PSU之间签署的，PATERNO家没有资格质疑。但现在法院明确认
为PATERNOS家有资格质疑。这一判决之所以重要是因为法院实际上认可了PATERNO家有

句。不要总以为别人是无知的，这个事情媒体的cover是很深广的，也许我没有去时间
读完两份调查报告，但是媒体的正反平衡报道从那个后来得普利策的系列开始基本能看
的都看了。
要不是自欺欺人，或者偷换概念欺骗不知详情的外人，不会不明白：
NCAA处罚不是基于Sandusky的刑事案件，而是因为Penn State football program自上
而下，从JoePa到Univ Police到校长的cover-up action。处罚也没有针对JoePa个人，
而是对于整个program，取消十几年的成绩，由此才伤及Joe的winning record。
最根本的就是一个问题，01年McQueary告知JoePa这个淫棍的事儿以后（还有说知道的
甚至更早），一个系统都像鸵鸟一样埋着头，简单处理后几乎不作为，继续让他access
football facilities，还参与青少年Sencond Mile，完全是放狼入羊群的行为。从这

简单前，前面宾州告NCAA的案子直接被法官DISMISS了，也就是说起诉不成立，不需要
进入庭审环节。
而这次，PATERNO家告NCAA被法官接受了。千万别小看这个决定，这说明下一步要进入
双方律师DEPOSE双方人员的阶段乃至庭审。重罚我狮的关键策划人，NCAA的主席EMMERT
将会被PATERNO家的律师录口供乃至出庭。这可不是闹着玩的，一旦UNDER OATH，什么
内幕都会被扒拉出来。

出的不予接受此案的要求的裁决。换言之，法官认为，原告的起诉是值得继续审下去的
，是有些根据的。
这样的法律文档读起来比较枯燥，但实际上非常严密。我在休斯敦工作期间和不少律师
合作过，当过EXPERT WITNESS，对律师有一些浅薄的认识，多少理解了一些他们的专业
工作和需要的知识技能。
对此裁决的要点分析如下，全部是用门外汉的话说的：
1、PATERNO家告了NCAA，但没有告PSU。NCAA认为PSU是一个INDISPENSABLE方，原告没
有告PSU不对。所以将此作为一个理由要求法官DISMISS这个案子。
法官对此的裁决是：PSU的确是不可缺少的一方，被告的OBJECTION可以SUSTAIN。
2、PATERNO家告NCAA诽谤或毁坏名誉（DEFAMATION），一共提了5条诽谤的COMPLAINTS
，NCAA全反对。
法官对此的裁决是：第1条和第2条成立，后3条不成立。换言之，法官认为在第1点和第
2点上，NCAA的确有可能损坏了被告的名誉，值得继续查下去。而后面3条不值得或者无

I do not believe the NCAA sanctions were perfect and in fact were far from
it. Requiring the State of Pennsylvania to send their tax dollars to other

严罚严惩的没啥废话。
哥说的是NCAA是否因该介入？你可以考古看看光NCAA版当时就有多少不同的意见， 很
多非我狮球迷同样认为这属刑事案件，不属任何NCAA范畴内的球员纪律问题，NCAA不该
介入，人家球迷大脑比屁股玩的转，好不？ 惩罚条例出来，有很多人认为过于“harsh
”的，当然也有不少认为 “inadequate” 的，自己放狗去搜。
既然又提到案件本身，请问读过Freeh report了？但读过Paterno Report 没？ 了解
BOT里成员和Second Mile的关系麽？了解州政府和校高层的争斗麽？了解处理此案中很
多法律程序上的纰漏麽？水之深，深了去了，非你我想象，此案还未结束，我狮
football program 更多是被背后政治家用来提高对比度吸引眼球以快猛的方式达到目
的牺牲品罢了。
NCAA的介入，纯属随媒体潮流站舆论队伍，顺便在member前障显权利，不该管的非要管
，早就有人说这是自我添乱；该管的又管不好，导致怨声载道一片。NCAA自己扇自己，

As someone who has been critical of what I have perceived as the media’s
rush to judgment against Joe Paterno in the Jerry Sandusky scandal, I was
very eager to hear the results of the report by former FBI director Louis
Freeh. My primary concern through all of this is that the case against
Paterno for knowingly protecting a pedophile had not yet been truly proven.
