我刚被关了freedom和united，BBB之后把rewards寄给我了

己犯傻也没有选ESL，现在F1 visa被terminated了，我夏天还有三门课，大概8月份结束。学校
OIP要求我去做VISA reinstatement.但是有一定风险被denied。或者他们给我开新的I20我回国重
新签证。Reinstatement一般要好几个月，我现在开始申请基本上可以到我夏天的课上完，但是如
果被denied了话，就不能申请OPT了，我还是很想申请OPT的。如果我回国重新签证的话，风险有
多大呢？这里有没有比较了解的牛人或者之前做过reinstatement的人过来帮帮我，分析一下哪种
比较好。万分感谢~~

果前一阵收到原来的州的一封信，说我的保险过期，让我提供新的保险信息，或者交罚
款。我把我新的保险寄过去了。但是我的旧的保险是9月22号过期，新的保险是9月23号
开始。可能有一天gap。过了一段时间，又收到原来州一封信，这样写的
your registering privileges are under revocation for the following：
insurance cancellation dated 9.22.2011 since there was an 01-30 day lapse in
insurance coverage, a $50 reinstatement fee is required.
我现在有个问题就是假如我换成我现在所在州的牌照的话，还需要给原来的州交着50块

，完全忘了I20这回事了。。。。。。。。
国际办公室说要reinstate，要交申请。我看了下说明，reinstate只给继续Full time
的学生？而且至少需要两个月？我现在在改论文，准备下个月就答辩了。学分早就修完
了，早就不是fulltime了，怎么办？是不是连毕业都会受影响?
还说6月让妈妈过来探亲呢。。。。。。。。怪我一时大意，身份这么重要的东西居然
忙忘了。各位高人有什么办法吗？万分感激

对，你再看下面：
Working during request: If the H-1B revocation occurs before October 1, the
student may continue working past October 1 while the data fix remains
pending, because the student will still be in valid F-1 status.
If the H-1B revocation occurs on or after October 1, the student will need
to stop working before October 1, apply for reinstatement, and wait until
the reinstatement request is approved before resuming employment.

reinstate，这里reinstate指的是10月1日之间知道了10月1日以后被revoke。真绕。。

20。要填一个 reinstatement form. 有没有人有这方面的经验的？大概多长时间批准？

工业界工作了，现在又想回到学校继续读PHD（有教授愿意要我）。 请问H1B转F1
reinstate难吗？ 即F1 reinstate. 会不会有申请F1不成功，H1B也作废的情况？
另外 以后读PHD后，再回国，会不会因为以前有
H1B的经历， 回国返签不好过？

不会，申请即使被拒，H-1B也仍然有效，除非你辞职了。
BTW，这个不是F-1 reinstate，是change of status to F-1；F-1 reinstatement另有

在09/02/2011结束。我于03/30/2011 递交I-20 reinstatement(本人I-20出了点问题).
现在还在等I-20 reinstatement下来。可能要超过一个月以后才能下来。所以现在我的
F-1visa处在 pending之中。
我的问题是我可不可以在1-20 下来以前转成H-4 签证（我先生是H-1签证）。或者等I-
20批下来以后（到那时会过了grace period）再立即转 H-4. 还是必须回国再签H-4过
来。若有类似情况，急盼帮忙建议，不胜感激 |

，我收到了USCIS的notice要我补充材料。8月8日，我寄出了补充材料。8月底和9月15
日check，都是要补充材料。9月16日，我打电话去询问，说是没办法知道USCIS是否收
到补充材料，让我等60天。因为怕USCIS没收到，所以我今天又寄出了一份，不过已经
过了9月4日的due date了。如果USCIS因为没有收到补充材料而拒了我的H-4，我是否有
机会上述？
我先生的工作是8月29日丢的，虽然他的头说他的vacation pay不算employed状态，但
是human resource好像没有这样做。至少，他的pay check还是很正常的半个月一付，
而没有一次结清，所以可能到10月20日还是算employed的状态。这样的情况下，USCIS
会否知道，会否影响H-4的审批。如果H-4批下来了，那么将来USCIS会发现吗，对办理
绿卡有影响吗？我先生身份没有问题，I485 pending很久了。

发帖数: 3693 | 25 USCIS知不知道，取决于你老公的公司有没有去revoke他的H1，如果revoke了，那你的
H4自然也会被拒。找HR问清楚吧，要是他们还没有递交revoke的申请，那得跟他们商量
尽量求他们不要这样做或者尽量晚点交这个申请，不然的话，不光你的H4下不来，你老
公的pending 485也很容易收到RFE.
F1 reinstatement比较risky，因为你必须证明out of status的原因在你个人的掌控之
外。而且在你的case未必能work，因为理论上F1入境时间只能在开学前三十天之内，而
五月到十一月之间加起来的话你身份失效就超过过了六个月，别说reinstatment没戏，
再出境的话就三年不能再入美国，要洗黑就得等你老公成为公民了。
H1必须拿到批文才能出境签，以你现在这种灰色身份，批文恐怕不易拿到，还是赶快找
个好律师问问吧。 |

1. 加拿大的签证我可以拿H-4 pending去申请吗？有人说必须有合法身份才能申请。
2. 我失去合法身份超过6个月的话，对将来绿卡申请是否很不利，究竟有什么影响？
3. 我是否应该先做reinstatement（如果再不做，到10月就要超过5个月不能做了），
然后等H-4的结果。如果H-4被deny了，我再出境签？ 如果H-4签过了，立刻递H-1b的申
请，并withdraw the reinstatement 呢？H-4的结果根据USCIS客服的回答，到10月中

一稍后H1 transfer 被据，能申请F1 reinstatement么？这H1->F1 pending符不符合F1

2008, renewed H-1B for 3 years.
2010, entered US using AP, got I-94 for AP, and so terminated H-1B and
became AOS.
2011, got H-1B renew from October 2011 to September 2014.
Since H-1B extension is granted, I should come back to H-1B from AOS. My
question is, exactly at what time does the reinstate happen? The new start

伸H1B,
这样的(H1B/连带H4)是算一个案子,还是两个?

BBB投诉了。然后通过BBB与ebay有了communication, 然后提交了PG&E bill, 然后ID就
被reinstated了，而且昨天还突然给这个ID发了$15 coupon for first listing (虽然
这个listing第二天就被ebay删除了，随后ID就被suspended了)。被告知当时被
suspended的原因是周五要求验证身份，结果整个周末我不在，结果因为没有及时验证
身份，到周一ID就被suspended了。
