发帖数: 5148 | 1 根据你这个情况，SELLER 是肯定应该退回Earnest Money的。 而且也没觉得你的AGENT
有什么失职的地方。应该要求他们签那个标准的RELEASE Earnest Money的合同。正常
情况都没有人愿意去打官司的。如果碰到非正常人，如果真需要走这步那就走吧。不过
这个对双方都没好处。我的建议是这个事情你要让你的AGENT出面多一些，而不是你自
己出面。可以态度强硬点，因为目前没有看到你方有什么问题。而且你的AGENT也可以
让他/她的BROKER出面和SELLER 的AGENT的公司谈判。因为如果上法庭，双方的BROKER
也都是会被牵扯上的。所以有时候对方AGENT就会劝说SELLER的。而且这个本来也是他
们不在理。
你现在也不用考虑他有没有DISCLOSE TERMITES，有没有构成欺诈，这些都不是我们想
像的那样。到时候一定要一个做REAL ESTATE LAW的律师来给你分析的。

那就凑和了... 差多了, 没那么多DOWN PAYMENT, 当然贷不下来...
合同RATIFIED之后, 理论上BUYER只有两次机会再去看房子. 一次是做HOME
INSPECTION, 另一次是在过户之前的FINAL WALK-THROUGH. 其它时间, SELLER都可以
拒绝你去看房子. 如果没有HOME INSPECTION CONTINGENCY, SELLER完全可以合理合法
的不让BUYER在HOA有效的期间内检查房子.
很多人在合同RATIFIED之后, 觉得可以随意再去看房子, 那是不对的. 是SELLER没和
BUYER叫真儿. |

现在有的seller一共只给5%的佣金，listing agent/buyer agent每人2.5%。

details of commission agreement between seller and listing agent would make
impact on the price I'm gonna offer.
I did ask the listing agent and was told that the information of commission
agreement is kept confidential.
Anyway, I don't think the seller would be willing to give 6% when he know
there is no buyer's agent.
And, is there any possibility to ask "listing agent" for a rebate?

一打听，原来5月中旬这里有比较大的一次hail storm，冰雹把很多家的房子屋顶都砸
坏了。我们找了一个contractor来做了inspection，说我们的房子屋顶也得换。冰雹是
在5月中旬，正好是做完了home inspection之后、close之前的日子。我们立刻通过
agent联系seller那边，那边一开始说他们的保险公司说weather report上没有冰雹这
回事，直接ignore我们。我们给他们看了National Weather Service上关于本地区5月
中旬的hail damage report还有contractor的estimate，他们开始退一步，但是不说修
屋顶也不说不修，只是但是要让我们的保险公司和他们的保险公司交涉。我们联系了现
在的保险公司，人家听完了说，这事和他们没关系，因为是我们的policy之前的damage
，不管，他们也不愿意出面和对方扯皮。球给踢回来了，没办法，seller那边一如既往
的有一搭没一搭的回复我，跟我们耗时间。

try and use eBid.net.
They are obviously not as large as the monopoly eBay/Paypal, but they are
big in UK and has about 3 million auctions running.
The way they work is 3 subscription styles, BUYER, SELLER(3% ON ALL CATEGORY
SALES) AND SELLER+(NO FEE, AFTER PAYING FOR SUBSCRIPTION).
Its definitely something to help out and try out to prevent eBay from being
the monopoly they are.

的他们拿不到多少钱. 给个合适的OFFER一般都会从的. 如果你说的是真的话, 他们正
