1. 为什么写这篇文章
在2016年, 我们写了两篇有关我们商业地产投资的历程。这里想接着写一些我们的感
想和历程,并做一些补充和更新。
还是在第一篇文章中说过的,我们写这个系列的文章,主旨不是要推崇某种投资方式。
而是想给大家一些思考的素材。保持一种开放的心态,积极思考、探索自己可以理解并
且适合自己实际情况的投资,这样才是最好的方式。这个系列的文章如果让我就说两点
有关投资的话,一个是开放的心态(open minded),一个是多元化投资组合(
diversified portfolio) 。其他的都忘记也无关紧要了。

从其他州来西雅图实习三个月,来之前在craigslist上找到这家在Redmond附近的房子
。白人邋遢女房东,离异,带俩领养的孩子。入住第一天就被要求交了(deposit,首
月房租+水电费,最后一个月的房租+水电费),有收据。
1.我入住和交房租的时候没有告诉我房子要卖,所以我房租一直交到了8月底,结果现
在才6月,通知我说房子卖了,要让我搬出去。房子已经在陆续腾空,很多东西已经不
在了,还要求我必须住到他们彻底清空的那一天(大概6月29).
2.迟迟不退多交的房租和deposit,万般抵赖,有可能想赖账。
3.最最狗血的:从我住进来到现在的一个多月,房子里住过不同的三条狗,不知道那条
狗带进了跳蚤,我被咬的浑身是包,看着极其恐怖(附图)。开始的时候,她去买了杀虫
剂,骗我说是无毒的。而且白天我不在的时候不喷,非得在我睡觉的时候喷,结果我在

Texas property code § 92.010 has an occupancy limit of 3 adults/per bedroom
.
as for security deposit, Texas property code §§ 92.103-104,109 governs. A
landlord is obligated to return a tenant's security deposit or give the
tenant a written description of damages and charges within 30 days if the
tenant gives the landlord a written statement of the tenant's
forwarding address for the purpose of refunding the security
deposit.

First of all if you are in rental business, you need to know the law well
for your area. (some county and city can have more laws on top state and
federal ones)

Read this at least 10 times until you completely understand what each one

I have obtained a request for possession on the 11th day after the first
trial judegement. On July 3rd there was a police man went to the property to
serve the eviction notification, and on the same day the tenant filed a
motion trial(new trial). Yesterday when the policeman went back to the
property and to check if the tenant has moved out himself. But the tenant
showed a court document to the policeman,which is the eviction is on hold
and there will be a new trial.

我是Cocoa(断了腿的小黑猫)的妈。 Cocoa现在疗伤中。
这次是其他事情需要大家的指点。
昨天发现地毯上有孤立的一小块湿的地方,当时想了半天都没想到是什么原因,还以为
是什么时候不小心洒了水。今天早上发现有水从墙上滋出来才知道是Water heater 水
管裂了,喷出来的水线把墙给穿了个洞(虽说我们这个property是80年代建的,这墙也
太松糕了)。看来水漏了一两天了,把楼下的屋顶都淹了(好在楼下现在没人住,是空
房)。也正是因为没人住,所以也没人知道。
来修的plumer说一般如果lease里规定renter必须负责室内的损失或者规定住户要买
renter's insurance, 修复的费用就要我负责。

因为我们这套房子里有太多的蟑螂,家里有宝宝(8个月),而且我们也找房东(是个
蛮大的公司)很多次来解决这个问题,都解决不了。有一次还在宝宝的床上发现了蟑螂
,真的受不了了。所以想argue一下终止合同(合同7月到期),大家觉得有可能么?在
美国呆时间久经历多的兄弟姐妹们帮帮忙啊。。。还有要怎么去argue才合适呢
下面是我在网上找到我这个州对这种情况的法律规定:

我8月份close的房子。是个shortsale。快Close的时候发现里面有tenant,要求搬走。
他们说没法在短
时间找到房子,搬不出去。而且他们有lease直到年底。但租金非常低,才800一月,这
个房子的市场价是大约1300左右。我当时就不乐意了,想back out,不买了。卖方
agent说他们的lease根本就不是和当时的owner签的,而是和之前的tenant签的,无效
。我还是不干,觉得他们赖着不走很麻烦。他们就说服tenant9月底之前搬走,并且由
律师起草了一份lease的addendum。大意就是tenant 同意9/30之前搬走,并且保证走得
时候不故意毁坏房子。如果违反,我们可以evict。房客和前任ownder都签了字。并且
有realtor做witness。我想既然都签了这个了,应该不会赖着不走了吧。
结果昨天电话给tenant,他说他还没找着地儿搬,想和我重签lease。我想想说也行,
但rent得涨到1200。当时他答应了。结果今天他又变卦了,说什么以前的lease有效。

i have a single family house in stoneham. I live on the first floor, i rent
out the lower level. Because there's only half bath room down there, the
tenant need to come upstairs for shower. My tenant is ten yrs younger than
me...he usually locks the door when he's using the shower....
The same with previous tenant, am. boy 24-25ish...he locks the door as well.
...
it's just a personal habit for more privacy...no other thoughts..i'm
completely ok with that...

我们看中了一个condo,现在要签lease了。lease上说"if the landlord wants to
sell the unit, landlord shall have the right to end this lease by giving 30
days notice to tenant. If the landlord gives tenant that notice then the
lease will end and tenant must leave the unit at the end of 30 days period
in the notice"。这是不是说房东可以随时中止lease而不需要任何理由?那签一年的
lease还有什么意义呢?

No such thing about a upper limit.
It is all about what one can prove in law. If the landlord can prove the
carpet's common use year is 10 year, then it is 10 year.
You have to provide which state you are in and read the tenant law (
especially the terms about security deposit) carefully.

I will read the Landlord and tenant laws carefully.
Now the difference between my situation and yours is that they really did
replace the carpet and gave me the invoice, although the number is a little
bit more that what they charge me. However, the number on the receipts for
replacing the damaged kitchen floor and counter top is more than what they
charge me.

前段时间搬出住了3年多的公寓,客厅地毯是被我家弄得很脏了。更惨的是自己洗地毯
的时候掉了bleach在进门的地方,很大一块颜色都不一样。 心里知道会被扣钱。
后来收到公寓的退款支票和扣款清单,但是没有提供任何证据。说扣款中包含换客厅地
毯花的$500刀。 我觉得太多了。就钻研了加州的tenant law. 发现加州还是比较保护

上周apartment 邻居家里失火,两户房子被完全烧毁,其余的14户也受到很大影响!整个
building的住户都被强制搬了出来. 暂时住在同一个小区的另外一套房子了.
今天房东召集开会,只愿意提供另外一套房子,但搬家费用得自己负担.而且提供的房子

I will move soon so would like to find a new tenant to take over my lease (
current term up to June 30, 2013; you have the option to renew the lease
when it expires). Rent is $2,163.67 (by taking over my lease, you are

不知道发这里合不合适,但这里租房求租的人多,想必都见多识广。
未来房东最近把合同发来了,关于租约有几点不明白请教大家:
1. maintenance and repair
这个说是要Tenant完全自己负责。比如下水管道堵塞啊,门窗玻璃各种硬件等等。由于
屋里还有Washer/dryer,虽然这种概率很小,但如果洗衣机烘干机坏了,难道我还要给
他买新的吗?
2. Attorneys' fees
合约说到,如果遇到纠纷屋主认为有请律师的必要,tenant必须承担所有费用。这个合
理吗?
3.Indemnification
合约说屋主对tenant以及进入屋子的各种人在屋内的任何Damage和injury完全不负责。
这个。。。我从小对吊扇有点杞人忧天,总害怕会掉下来。。。这屋里有两个大吊扇,
万一哪天砸下来砸着我,至少说明设计有问题或者安装不牢或者屋主没有好好检查,也
不用负责吗?
4.Inspection
说屋主可以在任何“reasonable times"进入屋子检查或者进行维修。我觉得这个说的
太模糊了,是不是可以跟他商量写清楚,比如早8点到晚8点,要在我在场的时候,或者

第一个tenant搬走了,发现bathroom的counter top被烫坏一块,大约一个乒乓球大小,
counter top不是那种最普通的,但也不是granite,应该是某种复合材料整体成型的那种
.虽然不影响功能但是很影响美观,目前可以不还,但是以后卖房子什么的肯定是要换的,
价格应该不便宜,我该怎么扣tenant 的deposit?
另外我租给他的时候肯定是好的,当时这个地方没有拍照片留证,但是这个tenant进去以
后一直也没有给我交condition form,是不是应该就默认为是好的?
