目前的情况是大约一个半月前看上一个房子价格40万，我签offer，一个月close,并且
付了4000刀earnest money
然后lender一直批不下来。然后我们被迫在close前换了一个lender重新申请，并把
close date延伸了半个月到上周五。
结果这个lender要求各种材料，其中一个很重要的材料是要求对方出具 材料证明deed
restriction可以让owner在火灾后重建。seller一直没有提供这个材料。最后lender也
一直pending,没有approval我的贷款。我们要求lender extend contract 被他们拒绝
了。现在contract expired,seller以我们没有perform来在close之前申请到贷款为理
由要求earnest money。
我觉得lender不批准部分也有他们没有提供deed restriction的材料有关系。我要求
bargain，卖方不同意，要求拿走全部earnest money请问这个如果上法庭有多大可能会
赢？
实在紧急，请求版上大侠指点一二 |

如果都被accept了，你还有inspection contingency and sometimes loan
contingency. 通常是17天。在这17天里面you basically can just walk away. 签
offer的时候卖家可能会要求缩短这个window到10天什么的。也有的bank owned/short
sale要求不给contingency的，但那是exception.
earnest money 也不是下offer的时候就被取走的。Earnest money only becomes
theirs to keep after the 17-day window. 还“sue for damages
due to fraud”，搞笑，吓唬谁呢。她/他要真这么觉得 |

下款来 （有银行reject 的信）， 你的earnest money 是要得回来的， 过了loan
contingency， 你如果没贷下款来， 要不你就拿cash 来close, 到closing 的时候如
果你不够钱，
你的earnest money 是要不得回来的， 而且卖方还可以pursue liquidated damages .
....
有权利cancel contract的。也就是有可能你在25天的时候办好loan，seller突然说卖
给别人了,如果contingency没有extend的话。当然，seller如果发现buyer在这21天内
没有做任何事情，可以sue buyer。所以很多合同还有规定几天内必须开始贷款，几天
内必须inspection等等条款。如果buyer在规定时间内没有做这些事情，deposit可能不
能拿回来。 |

realtor解释过deposit可以在mortgage无法put through时退回，earnest money能退吗

发帖数: 242 | 48 我们最近下了一个short sale的offer. 没有交earnest money。合同上说等银行批了之
后再交earnest money，再做inspection. 由于等了很久银行也没有批，期间有看到一
个合适的房子。于是就买了，周三closing。现在short sale的房子批了。我的agent给
seller写信说终止合同。那个seller不同意，说一定要我们买。否则就起诉我们。
我的agent说先不理那个short sale 的seller。等周四他再写信解释。而且那个seller
的agent也和我的agent口头说过，如果我们发现新房，可以终止合同。现在我和老公都
非常烦。
大家觉得我们应该先close吗？ 如果我们现在close了，我们的agent将来是不是就不需
要管这些事情了？

发帖数: 242 | 49 多谢大家的回复。我们签的合同就是一个standard的购房合同，除了加了一条注明：
the buyers are aware this is a short sale subject to lender approval.
Earnest money and inspection to begin after lender approval. 所以贷款和
inspection contingency肯定是有的，就是不知道从什么开始算。
我们是根本没收到任何lender approval letter，agent说收到过电话，但是没有任何
东西in writing。实际上他是在收到电话的当天发的termination of contract（10天
前的事了），但是seller不肯签。
这个房子listing agent一开始是说要签一个binding contract subject to bank
approval，也就是要交earnest money，然后他可以保证45天内close。但是我们不同意
，因为listing agent也只是口头说可以45天内close，我们不可能这期 |

买房有很多contingency, 比如inspection contingency, loan contingency等等。就
算earnest money交了，escrow opened，也有17天的contingency period. 连最后什么
都sign完了，还有72小时可以反悔，当然那就要扣earnest money了。
LZ这个，连earest money都还没交，根本什么obligation都没有，不用给理由就可以
walk away.
那边seller还号称要告？自己是agent很了不起么？这房地产agent做的，自己的房都要
被short sell了。还牛X那。真够逗的。
