这是一个回帖,但考虑到是一个常见的问题,所以单独开贴来讨论一下我的看法,抛砖
引玉。
合同写的不一定合法。建议你咨询一下律师或者city有关部门。美国多数地方法律倾向
于保护租客。如果租客找了人来sublease,而房东拒绝的话,造成的损失很可能需要房
东承担,无论合同是怎么写的。
按照good faith的原则,房东和房东都有责任避免空置。举个例子,假设是在加州。
租客在合同未到期的时候提前搬走了,然后房东就有义务去找新租客。当然如果尽力了
而找不到,那损失有租客承担,但如果不尽力找,或者租客推荐了合适的信租客而房东
拒绝,那损失几乎一定是由房东承担 ----无论合同怎么写。
我有一个建议,不一定最好,但你可以参考一下。
1)找人来sublease,然后对方表示愿意接手房子的意愿(可以用email证明)
2)找房东商量,获得房东拒绝你sublease的书面证据,也可以用email之类的。
3)去小额法庭,起诉房东

你这个情况landlord很无理。你的lease还有2个月, 最差情况就是你把下两个月的租
金付了走人,1年的lease正常结束, 他是绝对没有理由扣你的deposit的。如果他
lease结束之后21天不退
deposit,那你可以去small claim court告他 and ask for 3x the deposit.
我去年有个特殊情况,一个12月的lease在7个月的时候必须break, 一开始landlord也
气势汹汹,说要扣2个月rent加full security deposit, 等他重新租出去之后根据房子

请教法律问题:关于中止APT Lease的
俺几年前在Elmhurst租了个apt,后来lease到期renew了,现在的renewal lease规定如
果俺要搬走,需要给landlord 30-day written notice。俺打算10月6日搬走,于是9月
6日打电话给landlord商讨关于notice的问题,被告知只需要写一份notice然后fax给他
即可,但俺需要付整个10月份的rent。俺觉得很不make sense,遂问之,landlord回应
说这是by law。
landlord不是私人,而是一个management company。所以觉得对方骗我的可能虽然有,
但也可能对方是对的。google了一下,发现一个和俺类似的案例,但俺看不懂第一个回
答者引用的那段statute。请懂法律或者有类似经验的朋友指教一下:俺的landlord的
要求(即付整个10月房租)合乎法律么?谢谢!

In my county, there is an agency called "landlords and tenants office". I
would call the county landlords and tenants office to get advice. I suspect
the landlord is illegal/unregistered landlord, which means he does not want
to leave any evidence that he leased his house to you b/c he needs to pay
tax for the rental income. You can find out whether he is in the registered
landlord database in your county.

distance to NJIT.

lives in the third floor.

1. Under the state law, the landlord doesn't have any power to enter the
tenant;
2. The limit for people who're living in the apt must follow the rule
according to the State Law, City and Town;
3. For the visiting guest, I don't think the landlord can take any legal
action. The landlord can 'No sign the lease when it finished'

Lonewolf, here is a real example: Landlord tried to evict a tenant. At the
same time, the tenant intentionally puts stuff into sewer to jam it, causing
it backup and dammage the house. The tenant calls health agency and local
TV News group (It is a big landlord, and TV news like the story about weak
tenant against nasty powerful big landlord), saying that the landlord
provides her a bad living enviroment, complainting health issues, headace

are there a lot of answers from a landlord?
Once I lived in an apartment of school, and it was caught by fire. I didn't
buy any rental insurance. And the school claimed the fire was by arsonry
after a couple of months involved police investigation (but I doubted it
might be kind of the school's excuse). But the point is the school claimed
no responsibility by any means with the prove from police, but it reimbursed
all of our loss, generously.

第一次在MIT上发帖,希望大家能帮帮忙。也许钱不多,但是对现在还是学生的我们来
说,却是个很大的数目了。
情况比较复杂,大致如下:

房子的租期是今年6月1日到8月1日,短租的暑假,租金750每月,security deposit同
样的数目。与其他两名室友合租。
8月1日查房的时候房东发现她的granite counter top有一块变色了,很不高兴,想把
整块counter top换了,说要扣留我们的security deposit,会找公司报价之后再联系
我们。她说肯定是我们把烫的锅子直接放在台子上造成的。我们一直不承认。因为那一
块地方是放的调料,从来没有放过锅子。而且granite就是因为抗高温的特点,才卖的
比较贵的。
她说换变色的部分counter top不会太多,也就几百块。
我们当时就觉得,几百块对她来说不多,对我们来说太多了,就据理力争。
首先,变色的原因不明,如果是因为烫坏了,那就根本不是我们,如果是其他原因,倒
有可能;
第二,我们不能确定在我们来之前是不是已经变色了。她说我没有在入住查房的时候写

My husband and I, with our three children (then 5 and 2 and 1–years old)
moved in this place in fall 2008. Not long after we moved in, we found that
the window paint, which were loosely chipped everywhere, had lead paint and
asked the landlord to at least paint it well. The landlord refused and

你查一下local 法院的网站,上面会有具体程序。费用很低。
打官司前,你要先给landlord有个书面通知,要钱,并且证明landlord已经收到了(这
步可以看似多余,但是可以防止房东在法庭上耍老奸)。
然后,上法庭起诉他,如果你手上有landlord的deposit收据,100%你赢了。
身边的例子是,收到法院传单,landlord就付钱了。

Not necessarily.
It could be that they communicated about those stuff, and the landlord said that they can give them to her instead of throwing them away.
I know many of you think those are junk. But it still could be established between them that the landlord consider giving those stuff a favor. People are different. The tenant may be trying to make the point that those are not left as junk for the landlord to clean.

which State? In Michigan, when tenant moves in, there is a checklist of the
conditions of property. When tenat moves out, there is another checklist
of moving out condition. If landlord purposely holds tenant's deposit,
tenant's will get double money back from Landlord in court.

真实体会到什么叫"躺着也中枪"。 最近突然觉得好像有一个多星期,一封信也没收
到。于是联系邮局,过了四天,总算打通LOCAL OFFICE的电话。说是我LANDLORD通知说
我的房子VACANT了。我早上打电话给LANDLORD。LANDLORD说他们只会通知邮局有人搬来
,不会通知搬走。 LANDLORD于是给邮局打电话,得知邮局最近换了一个新的CARRIER,

我们是租人家的condo, 楼上的那套被foreclose很久了, 一直没卖出去。 前阵子发现
卫生间天花板一角有大泡泡, 就是涂料鼓了出来, 我们卫生间外面过道里的地毯
也湿透了, 楼里的manager检查了才发现二楼卫生间漏水。 现在他们把楼上修好了,
我们卫生间的泡泡也憋回去了。 一早通知了我们的landlord, manager说landlord应该
派人检查天花板的受损程度, 然后让楼上的赔偿。 但是我们的landlord一直没派人来
。 从外观现在看不出任何问题, 但是他就不担心里面发霉什么的吗?
我们挺喜欢这个unit的, 但是如果墙里面长霉了, 会对我们有影响吗? 那个天花板
涂料还是什么层能hold住水, 应该也不会透出霉来。 但是再旁边就是换气扇, 为什
么同样高度水就不会从那儿出来, 而是在角落形成water dimple呢?
作为renters, 我们一发现问题就通知landlord了, 反正这个也不用他出钱, 应该是
楼上的问题, 怎么他就不着急检查修? 我们应该坚持他开天花板检查吗? 我LD过敏
很厉害, 常年吃药喷药的, 有点替他担心。

1. Keep all evidence inclduing pictures and his letters and communication
emails.

Your landlord needs to deposit your safty deposit in a bank in your name.
They need your SSN to open an account and for tax purpose (you need to pay
tax for the interest). That's the law. You need to give your SSN to your
landlord. Remember ask your landlord the bank information, if he did not
give you, that's against the law.
If your landlord did not deposit the money in your name, or when you move
out, your landloard dod not give you the interest, you can sue him.

We are a couple with one kid, we did not use the hot water that much.
I highly suspect the landlord did something on that. I suspect that we also
paid the bill for the landlord who live downstairs. But I called the
national grid, I was told there was two separate meter for both downstairs
and upstairs.
Is it possible that the landlord did something and then used our gas for the
hot water?
Anyone had any bad experience on that?

“Just cause eviction” is the buzzword given to a form of rent control.
There are various flavors around the country, but the general idea is that
it should be difficult or impossible to evict tenants who refuse to pay a
rent increase.

landlord 写明问题 和你想要的结果(留证据) 如果landlord没有在合理时间里解决
问题 算是constructive eviction(因为已经不能让你生活) 你查查CA law的这方面

Do you live in San Diego? It is very easy. Just move. If the landlord dares
to go after you, see him in the court. Even you signed a contract, the
landlord has to prove that he made "reasonable attempt" to fill the vacancy
but couldn't. The CA court favors the tenants.
Therefore, you can see why so many people who want to be landlord on this

tear。你不能说租户搬进去时地毯是新的,两年后租户搬走,他要付这两年的折旧费。
好像IRS规定的地毯的折旧年限是五年。这是作为报税用的时间段。很多人也用这个作
为地毯的折旧年限。
如果租户有损坏地毯或者造成地毯不可逆的污渍,租户要付一定的赔偿。赔偿金额是基
