2: annual report
3: audited financial statements。
另外有一句说If the petitioner employs 100 workers or more, the petitioner
may submit a statement from the petitioner's financial offers which
establishes the petitioner's ability to pay the proffered wage.
这是不是说，100人之上不需要3种证明之一，只要一个证明信就可以了啊？

Information About the Petitioner, 1b一项律师给我填的是Self。另两项1a
Employer， 1c Other律师都没有选。
Part 8. Signature of Petitioner律师要的也是我的签名。
Part 9. Signature of Person Preparing This Petition, If Other Than the
Petitioner填的才是律师她自己的信息。
虽然这个只是NIW的表，不过律师只是Preparer，我自己是Petitioner，这个应该跟NIW
/Eb-1a没什么关系吧？ |

if its an american citizen applying for a spouse - then the american is the
petitioner and the foreign spouse is the principal applicant.
the same goes for any american applying for a close family members - parents
, children and siblings.
When it is an employer applying for a foreign employee then the american
employer is the petitioner and the foreign employee is the principal
applicant.

断申请人不够强所以拒绝的么。
我看了看判例里头Final Merits Determination 中扣得比较细（这个判例本身是3个标
准中通过两个，拒绝一个的，但是在Final Determination里头有很细节的描述），要

收到mail一看，居然是大名鼎鼎的杀手0603.
claim了老三样，承认了authorship和judge， 不承认contribution。
感觉这个IO根本不看推荐信和petition letter。我的文章被牛人在review中大段引用
，被书引用，有杂志基于我发表的文章邀请我写热点介绍的文章，我请这些人写了独立
推荐信。那个专利请原单位的副总写了推荐信，说明专利如何得到应用。
考古了一下版上对这个IO RFE的应答，好像不太乐观啊，是不是与其绞尽脑汁与他纠缠
，不如 withdraw 重新递，碰碰运气更靠谱？求过来人建议。

我刚才在www.eb2niw.com看到了一个帖子。里面统计了300+个在2012年全年和2013年1
月期间approved的NIW case。我相信这些数据对大家会有帮助的，故特地copy过来分享
。虽然它们来源于NIW的case，但对于办EB1A的人也应该有一定的借鉴意义。
另外，原作者还统计了这些approved case中，有多少曾收到过RFE。
还有一点需要提醒大家注意的是：从名字看，eb2niw的网站创立者Veronika Vaneckova
应该是俄裔的，她所统计的case在国籍上可能比中国律师（比如hooyou)更广泛一些，
许多petitioner由于国籍关系，NIW根本没有排期。hooyou以前也时常发布类似的统计
，但你会发现在publication, citation上面，NIW和EB-1A其实相差并不多。这里就出
现了一个问题：这些case里有多少是EB1A/NIW一起申请的（原因大家都清楚，这里就不

发帖数: 283 | 34 理论上，不是大问题。比方，如是律师帮申请，petitinoner 是律师。也就是说，第三
方作 petitioner 是允许的。可能的麻烦是，你收不到相关信件: approval notice,
or RFE letter。这些信件都是寄给 petitioner.
可考虑的修正方法:
1. 电话咨询USCIS, 问修改 petitioner 是否可能？
2. USCIS 网站允许修改地址，把 petitioner 地址改为你的地址？
3. withdraw 这份申请。会损失580刀。这是比较彻底地避免不必要的麻烦的法子。
有律师的话，最好咨询下律师。 |

十年的规定改变有点大。下面是我准备的材料清单。准备每个表格和配套的材料用一个
夹子夹好，然后每个form的checklist打印出来附在第一页。之前感觉前辈提供的清单
比起表格instruction里规定的清单要多，但想想本着缺不如多的原则，缺还得耽误时
间补交
，还不如先提供有备无患。
我是485， 130，765，131都一起交的。配偶是公民。有一起申请的可以互相督促学习
下～～

RFE by XM1307，质疑contribution，不知道是不是模版rfe或者杀手。
大部分citation都来自酱油文章，也没有亮点，感觉目前的推荐信和PL已经把可以挖的
挖过了。

作废了呢？
那么，我们不妨来研究研究之。
