你的理解是错误的。
30 day notice指的是tenant如果要离开,需要提前30天通知。
但如果是landlord要求tenant离开,叫做notice to vacate,这个一般情况下说的是“
房东至少给tenant30天”的时间,但在这期间,tenant可以随时离开,而房租只付到离
开那天。

按照你的理解,这就不是一个fair contract了
因为,谁intend to vacate,谁就要承担损失。
如果tenant intend to vacate,那么tenant承担在deadline前搬走的损失。
如果landlord intend to vacate,那么landlord承担在deadline前搬走的损失。
没有任何理由让tenant任何情况下都承担损失。

实际上谁intend to vacate谁就肯定不会有损失
那么这30天就是让对方有充分的机会来减少损失
tenant没有理由承担什么搬走的损失
假设tenant事先找到一个7月1日入住的房子,那么他6月1日的时候通知房东即可,6月30
日搬出,不损失什么.至于对方找的新房客什么时候入住那是对方的事情.
同理,landlord也没有理由替tenant承担
假设landlord事先找到一个7月1日入住的新房客,那么他6月1日通知老房客即可.老房客
的钱收到6月30日,不损失什么.老房客找到的新房子什么时候入住也和房东无关.
当然这都讨论的是month to month的情况,就是lz这种.要是有整年的合同那才是谁打破
合同谁承担损失.

1. Write a notice to your tenant by Mail or Email.
2. Pick up FAILUR TO PAY RENT form from DISTRICT COURT Room 212 at
ROCKVILLE town center.
3. Fill form and send it to court. ($12)
a. You must have the Rental Property License. Buy it from county web
site, the price is base on property type.
b. You must have SSN or work infomation of tenant.
4. Court will schedule and send a form with case number to you.

-In mid of April I realized that the March and April's rent checks were all
fake
-Then I sent him an eviction letter
-Then he paid me March and April rent, but $200 chekc was fake again
-Then I emailed him warning that he needed pay the $200 returned check plus
May's rent by May 10th, but he didn't pay.

完全理解你的心情和处境。
Delaware的相关法咱不了解,在MD,如果没有solid cause, 想把Tenant Kick Out,
不是容易的,因为法律倾斜于tenant。 像楼上说的,碰到这种Tenant,有时不得不送
钱请大神走,以防大神搬走前破坏房子。有些破坏可能当时发现不了。

if you are talking about auto gate which require code or gate opener, then
for some cases, there is no extra parking space and the host will have
visitor parking in their own spot. The parking spots are clearly lined up
with each house or apartment house. The visistor is not stupid enough to
park at a tenant's spot. and it is usually the tenant's right to call tow
truck.
Otherwise, gated apartments will always have a sign at the entrance that
states : tenants only.

房东无理扣押金是最容易对付的情况。
针对无理扣押金,你只需要写一封清楚的解释/威胁的信,用Certified Mail寄给他,
并要求收信人签字发给你,一般对方就会从了。
如果对方不从,去小额法庭告他,里面一般有专门处理Landlord/Tenant的部门,不用
请律师,咨询一下比较懂行的人就可以了。毕竟你这个金额比较小,对吧?

其实,找个中国女研究生做tenant,既不会拖欠房租,又不会开party
扰民闹事。在manager眼里应该是最省心的tenant。要是能长期住着,还省
得manager频繁的找新tenant了。

我看了,在default里
If Tenant fails to fulfill or perform any obligation under this agreement,
tenant shall be in default of this lease.
......
After default, tenant may be held liable for the balance of the unpaid rent
under this agreement if landlord cannot re-let condominium during the
remaining term of this agreement.
能说明啥问题不?

It depends. If you do not sign a lease with your tenants and he/she pay you
by cash or checks in the name of reimbursing your cost, you might be
required to report it as your income (especially when your tenant is your
relative). The safest case: when you rent a room in the house to your
relative, you do not need to report his/her rent as your income.
But if you sign a rental lease with your tenant, you might still evade the
tax by not reporting it, but there is a risk of being caught.

现在的tenant付房租到月底。然后lease结束。我们找到了新的tenant,但是被要求提前
给钥匙。
我们的问题是,如果提前给了钥匙,新的人搬进来了,但是旧的lease还没结束,虽然
旧的tenant已经搬走了,是不是合法呢?
提前搬进来的时间我们是不收房租的。是不是因为这样,就没有法律问题呢?因为我知
道是不能收double rent的。

I forget to tell you that there are many landlords are very litigious and
greedy. They like to use all kinds of excuses to threaten the tenants. And
even evict the tenants. A lots of tenants refuse to pay the rent because
they thought the landlord broke the lease first. When they went to the court
without paying the rent, the judge usually on the landlord side since many
landlords hire lawyers.
So that's why told you that this is a very sensitvive issue and you have do
everything legally.

请明白人讲解这个Renewal Term,看看是不是他有权利续租。
"Tenant shall have the right, exercisable as hereinafter provided, to extend
the term of this Lease for one successive period of one year(the "Renewal
Term") upon the same covenants, terms and conditions as those provided in
the Lease for the Lease Term. If Tenant desires to preserve the right to

I got response from the landlord,(a taiwanese)here is her reply with $200
check. I plan to keep the check in file and submit the lawsuit to the small
claims court.
I can have her another tenant as witness. The landlord withheld the tenant's
deposit about $400(total of $600).
About her bad faith, her response is:
"Our office suffers serious damages from Hurricane IKE. We lost power for
few weeks. Water damaged our computers and files. We tried as hard as we
could to restore our tenants' lives and

Please do not say you subleased or sublet the apartment. If you sublease,
you are still liable if the substitute tenant fails to pay the rent.
You tell the landlord that the lease was terminated when you presented a
substittue tenant who was accepted by the landlord. Also, the full refund
of the deposite clearly is the affirmative action taken by the landlord to
terminate the lease. You are neither liable for the remainder of the rent
due under the lease, nor for any act by the new tenant. The

几年前从郊区搬到了城里,因为房地产市场不好,我们就把郊区的townhouse出租了。
隔壁邻居是一对白人老年夫妻。女的自打我们搬进去的第一天就看我们不顺眼。男的是
Association的Board member. 在我们自己住在那里的三年里时不时会收到Association
的来信,说我们violate了这个,violate了那个。我们都尊照条款全fix了。后来出租
了,老太婆继续利用association的权利,时常给我寄罚单。主要是房客有一条狗,她
不喜欢,就想方设法赶走他。现在租给了一对年轻的白人夫妻,带了一条小狗。老太婆
还是不喜欢,老样子给我们寄罚单说狗的poopoo没有及时清理,小夫妻不愿惹麻烦,都
付了罚款。最近三个月,老太婆变本加厉了。
七月底,老太婆叫了警察,complain说狗的叫声太大。警察报告中说主人(tenant)不
在家,只看见backyard有两条狗,我们另外一边的邻居也租给了养狗的人。但是
Association还是寄给了我们$50罚单,tenant很生气,但息事宁人后来还是照付了。第

上周apartment 邻居家里失火,两户房子被完全烧毁,其余的14户也受到很大影响!整个
building的住户都被强制搬了出来. 暂时住在同一个小区的另外一套房子了.
今天房东召集开会,只愿意提供另外一套房子,但搬家费用得自己负担.而且提供的房子
楼层,朝向都不是我们想要的.仔细读了一下lease agreement, 里面专门有一段提到了

据明报报道,大学生纽瓦比(Rogers Afam Newbue)从2015年4月1日起,就一直租住士嘉堡区距多大分校不远的Howell Square一间独立屋的一个居住单位,从不交房租,房东只好找业主与租客委员会(Landlord and Tenant Board)协调,纽瓦比原答应在7月31日搬离,业主也就不再向他追讨房租。
等到了约定日期,纽瓦比出尔反尔,并要求委员会重新审议他的个案,遭拒绝后他便向地区法庭提出上诉。当司法程序开始后,逼迁令就只能暂停,于是他可继续霸住出租单位内。等到法官裁定要在12月6日举行聆讯,纽瓦比在聆讯前一日向法院发出传真,称这安排打乱了他毕业考试的时间,他无法参加聆讯,要求法庭再改期。直至安省地区法庭举行聆讯,法官在纽瓦比缺席聆讯情况下判他败诉,并勒令纽瓦比立即搬离单位。

Don't be afraid. It is not the end of world.
Landlords want business. You are a good tenant. If your lady friend is
willing to have a novation, the landlord shall be very happy. But, you shall
know that you need to notify your landlord about your intent to move out,
assign or sublease. As a tenant, if you are not specifically released from
liability, you will always be held liable. If your assignee/subleasee does
not pay, you will have to pay. You only have recourse to your subleasee.
