直租,非中介,房主原来户口在北京。独栋house,在皇后区最安全、最高档的社区之
一:森林小丘的Van Court富人区。犯罪率极低,女生深夜12点后单独从地铁站走回家
都安全无虞。邻居主要为犹太人、白人,几乎看不到黑人。
共4个卧室,1个带淋浴的大卫生间(一层)和1个不带淋浴的小卫生间(二层),带独
立车库。占地面积为40X100英尺,在森林小丘属于很大的独栋占地,如果你开车,停车
也很方便。房间10几个平米左右大,比其他几个房间略小一些,里面已有前面住户(中
国留学生)留下的床和基本家具,自己需要配置的不多,万一需要旁边就有Home Depot
很方便购置。纽约市最好的公立学校之一144小学就在马路对面,学校的操场、篮球场

eviction order 只能通过ud100拿吧。。。
建议不提forecloser, lease可以是oral的。。。
serve notice(寄,希望tenant不读)效期后, 立刻file default order, 通常
tenant不会answer court。 sheriff 不会理tenant/foreclosure的, 只是执行
eviction order。

very good news. I would sell it without any hesitation.
being a landlord is not easy, especially for long distance landlord. 1.5
hours drive may not be that bad, but your tenants may call you to come for
very tiny things such as changing a light bulb, switch a circuit breaker,
etc.
if the tenants do not pay your rent on time, you have to come to collect it.

第一个tenant搬走了,发现bathroom的counter top被烫坏一块,大约一个乒乓球大小,
counter top不是那种最普通的,但也不是granite,应该是某种复合材料整体成型的那种
.虽然不影响功能但是很影响美观,目前可以不还,但是以后卖房子什么的肯定是要换的,
价格应该不便宜,我该怎么扣tenant 的deposit?
另外我租给他的时候肯定是好的,当时这个地方没有拍照片留证,但是这个tenant进去以
后一直也没有给我交condition form,是不是应该就默认为是好的?

My answer usually no.
Normal circumstance landlord is not responsible for damages to tenants
personal contents, it's tenant own responsibility to obtain renter
insurances.
But if tenant had previously report to you there is a leak and you refuse to
fix the problem, then they may have a case.

Yes, "as is" means 如果发现问题,卖家不管修.
In real estate COE is Close of Escrow. Possession COE means that possession
will be after tenants that are current in the house are given their legal
right and time to move. In a month to month rental a tenant must be given 30
days in which to move out once a notice has been given by the current
landlord. With this you might have to wait awhile while the tenants move out
after the close of escrow.

which State? In Michigan, when tenant moves in, there is a checklist of the
conditions of property. When tenat moves out, there is another checklist
of moving out condition. If landlord purposely holds tenant's deposit,
tenant's will get double money back from Landlord in court.
If landlord 没有你的social security number, you don't have to worry so much.
Landlord just want to threaten you.

我们看中了一个condo,现在要签lease了。lease上说"if the landlord wants to
sell the unit, landlord shall have the right to end this lease by giving 30
days notice to tenant. If the landlord gives tenant that notice then the
lease will end and tenant must leave the unit at the end of 30 days period
in the notice"。这是不是说房东可以随时中止lease而不需要任何理由?那签一年的
lease还有什么意义呢?

and the new tenant moves it), that's $900/month.
The management fee is usually 10% of the rent, that leaves you $800.
Then the property tax is $250 per month, that leaves you $550.
So your maximal return is $550X12/$169K=3.9%. Something you could get with a
long-term CD. But replacing it with rental property, you have to add so

We have the right to enter the unit once the tenant has surrendered
possession- but tenant will be responsible for 30 days- even if they do not
stay for the full 30 days. Once you have vacated we do not have to give you
another copy of the lease- but in good faith we will as I told you in my e-

先写信, 没什么格式, 就说损坏是搬之前有的, 注明deposit送还日期,过期庭上见
,and will complain to BBB。。。
网上查"landlord and tenant court your county",上庭没想象的可怕,麻烦。 若
是民主党州, landlord/tenant law偏向tenant。

Skin color doesn't matter, ONLY look at credit score.
Simple: People wants to maintain good score will put paying rent first,

people who has low score don't care, and paying rent is not high
priority.

if you were a big apartment owner, taking on the risk is acceptable--perhaps
1 out of every 20 you will get a bad tenant. so it's all about your risk
appetite. if you just started renting, give it some time see if you get
other interest. taking in a tenant is always much much easier than sending
the same tenant out.

前段时间搬出住了3年多的公寓,客厅地毯是被我家弄得很脏了。更惨的是自己洗地毯
的时候掉了bleach在进门的地方,很大一块颜色都不一样。 心里知道会被扣钱。
后来收到公寓的退款支票和扣款清单,但是没有提供任何证据。说扣款中包含换客厅地
毯花的$500刀。 我觉得太多了。就钻研了加州的tenant law. 发现加州还是比较保护
租房子的人。房东要扣钱必须提供itemized receipts,然后只能扣换的东西的剩余价
值(预期5年适用寿命的新地毯你用了3年,全部换的话租户也只负担2/5的费用)。
于是打电话要receipt, 后来又写了一封信 (附上做参考),当面送信,让公寓签字画
押说收到了这封信。 后来拿到所谓的receipts才发现公寓提供了两个receipts, 一个

because you may waste more money on lawyer, court, sheriff, etc.
Start giving tenants a "3-Day Notice to Pay or Quit" immediately when they
missed the deadline to pay rent. If they still don't pay after the 3 days,

最近出租的房子房客打电话过来说水龙头坏了,经我们同意请了水管工来修, 费用120
元, 之前签订租房合同时,我的realtor 告诉我任何repair 低于50的由房客付,超过
50的部分由我们付。(他说这是一般租房子的惯例)签合同时也没有细看关于repair
expense 的条款。是这样写的:
repair expenses
any repairs costing less than $50 shall be paid by the tenants. All repairs
over $50 must be approved in writing by the landlord if the tenants elects

现在看这种写法太模糊了。 然后我的realtor 就和租客的realtor 在email 里打起来

查出来了是楼上楼下两家shared pipe堵住了。里面就是黑乎乎的油腻的东西(grease
)。
房东说是我们两家租户共同的问题,要我们付费,如果HOA不管的话。总共要1千多。
我们加州法律说是tenant造成的损坏,要tenants负责修。但是这种情况是我的错,楼
上的错,我们楼上楼下tenants共同的错,或者nobody's fault(就是,时间久了下水管
道自然会被grease堵)?
从法律上房东要求我们付钱合理吗?

我租住的是house里的一个apartment,房东在隔壁。签约的时候lease很长,没有细
看就签了。最近房东不时抽查我的垃圾,在kithen waste 里面发现一小块可回收的塑
料板,把它挑出来,然后就给我了一个25块的罚单。我argue 了一下,现在收到了
attorney 的律师函,要我交钱。
我签的合同是这样的“Village, County and State Law mandate that Recyclables
must be separated from Kitchen waste. A non-compliance summons can cost a

不知道你是哪个州,我去年有类似经历。加上有换roommate,换lease。
我刚开始叫我的律师给他们写信让他们把 我欠的账户清掉。因为那些只能算normal
wear and tear。后来apartment leasing management给我打了个折扣,让我少交一些
。还寄了照片。后来我查到我当时住的洲的一个去年六月出台的关于tenant和landlord
的一个修改法案:landloard必须在tenant搬出去时通知tenant做关于inspection,并
且五天内必须做inspection。所以后来他们送我欠的涨到collection agent,我律师给
我的意见是:就算是到credit beaurue,也可以dispute。dispute的内容就可以列举修
改法案的内容。那时候我还给leasing management打电话,跟manager argue是不是
wear and tear.我说这个东西很主观,我说你要说是damage就要拿证据,他说只能给我
看换地毯的发票。我说那个也不能作为地毯一定要换的证据,之类。我还说他们没按法

我在这个CONDO 住了10多年,和OWNER 一直没有问题,直到OWNER搬出,搬进了她的
tenant。一年半来,我一直和MANAGEMENT 和 OWNER 申诉,向MANAGEMENT 写了 10多封
COMPLAIN的信,一直没有结果。刚开始,OWNER还答应装一个extra PAD, 在CARPET 下
面。现在,她不但拒绝还不承认TENANT 有MAKING HEAVY STEPS.
MANAGEMENT 准备举行 HEARING, 由CONDO BOARD 做出评估,和决定。
这种heavy steps 对我们楼下的人影响很大,造成头晕,睡不好觉等等。
问题是,我们没有证据,录音效果不好,因为是这种vibration, 所以,录音不能把这
种impact录下来。
因为没有证据,所以我们就担心变成是she said, we said.
我们唯一的证据就是1年半来的COMPLAIN的信。

my tenants did the same thing. All kinds of excuses. You just have to
pressure them. Keep calling. Send eviction notice once pass due. You need to
assess late fee once they are late.
It is a persistent headache dealing with tenants. The best strategy I
concluded is to only admit female tenants. At least they can't trash your
condo as badly.

tough一点不用怕. 印裔大部分都care credit. 如果是黑人或者latino你就难搞了.
不过这种情况一般都是negotiate.
landlord & tenant的关系不用搞那么僵. 大家都是人. 逢年过节的时候landlord还要
给tenant送点礼物, 夏天搞个picnic什么的联络下感情的.
所以如果规模大了, tenants多了, 最好找个专业的agent.
一两户房客的话人际关系很重要. 很多时候可以当朋友处.

我开始还以为是谁把车停错了地方、或是有什么特殊原因临时停一下。但当我看到家里

)给了他的朋友!
因为房客曾告诉我他有个宾州的朋友12月底毕业后打算来NY找工作,在找到工作
前需要一个不查收入的住所,我当时还天真的以为这下可以多一个房客、多一笔收入。
眼前这辆陌生CIVIC的牌照正好也是宾州的,所以我可以100%确定这是房客提起过的那
位朋友的。
由于我的Driveway被这辆红色CIVIC占掉了,我只好给自己的2014 ML350找了个街趴位

跟agent约好了看房,到了那里agent说迟到15分钟,然后agent来了,说等owner,然后
owner来了,敲门,tenant很生气,不给看房,我们只好灰溜溜的回来了,这个tenant
也太凶了,owner也是,一般不都是等tenant搬出去之后再卖的吗?现在连房子也看不
着,还怕买了房客不搬走怎么办。

会问的问题,就是,我已婚,房子的title应该怎么写比较好?
在加州,夫妻共同买房有两个比较常见的title:
1. Joint Tenants;
2. Community Property with Right of Survivorship.
这两个title有很多对比之处就不一一列举了,只叙述两个与买房者利益最相关的部分。
首先,在产权转移上,两者没有什么区别,在一方死亡后,另一方都是自动继承死亡一
方的权益,例如丈夫去世,妻子自动独自拥有房子100%的产权。
那么,为什么在加州选Community Property with Right of Survivorship比较好?因
为从税务的角度考虑此种title可以极大的省所得税(Capital Gain tax)。例如,夫
妻两人2008年花费$600K买了一栋房子,到了2015年,丈夫因为意外去世,妻子自动继
承丈夫产权,并需要卖掉房子,此时房子价值已经涨到$2M。如果房子的title是按照

大家好,刚接到出租房房客的电话,得知由于她外出没有开暖气,家里水管冻裂开了,
并且水流到较低的楼层(我家出租屋在三楼,因此除了自家楼层,二楼和一楼都被水淹
)。她由于不在家,房子被本地的fire department break in并关掉了水管。因为现在
住的地方离出租房较远,得等到明早才能去看看淹水的情况,所以心里很没底,想先问
问大家有没有过这样的经验?我有买home owner insurance,但刚刚得知房客没有买
renter insurance, 所以我有以下几个问题:
1. 由于房客没有开暖气造成水管冻裂的损失(包括找plumber修理水管的费用,修理地

建议多看看雪妈的房东贴。
It is business. If tenants miss deadline, send a certified mail, telling
them rent is due and you may file eviction. Still no rent, file eviction
ASAP! They may give you all kinds of excuses, but whatever they say, they
are actually stealing your money.
Many people are trying to be nice to their tenants. However, many tenants
take advantage of landlords' kindness.

买的投资房 冬天到了tenant说温度上不去
找了plumber看 plumber说oil改gas是个极大的错误 什么coil不一样大 他调节了阀门
什么的 但别的nothing he can do.并且和tenant说想要房间暖起来 把温度开到75 说
bill会很高
tenant现在跳脚要搬家。。。。
求imore大仙和其他大仙指个方向
换个高大上(贵)的plumber公司去看会有办法处理么 总不能让再改回oil去吧

You can go directly to one of the 3 big credit bureaus Experian, Transunion
and Equifax for a credit report. However, I do not just check a potential
tenant's credit. I like to do a complete background check on them including

刚查了一下,这SECTION 8 租户不付押金的,是很可怕。哪天搬走前乱搞破坏,还拿他
们没招。
