超过10天，就不是‘偶尔’
加州法律规定，一旦有guest居住超过30天，就不再是guest，是tenant，
1天～30天之间，可以定为subtenant，但多少天算guest，多少天算
subtenant没有规定。房子title不是你的，对方有权定合同你签字。
第一：租房合同这么写没有违反任何加州法律，合同里怎么写的，到底是10天
还是100000天，你同意签字，就生效；
第二：这么写的原因第一个是阻止你sublet，还有utility fee，还有保险
的费用，住人多了保险公司有拒保可能。出了火灾你自负责任？你住房，那个
房子就在损耗，repair的费用landlord要负担一部分，多住了人，你付多少
给房东作为repair费用？
第三：如果房屋有potential hazard例如guest来的时候被插座电击，这个
责任应该是landlord+tenant负，看情况。有个guest，每年住超过10天被
这种无法预见到的危险伤害的可能增大，那个guest又不pay rent，凭什么
landlord负责？

apt for 6 months, California law protects tenants, etc. But what I know
the real case is if the tenant did not pay rent, after 30 days, landlord

1. maintenance and repair
这个说是要Tenant完全自己负责。比如下水管道堵塞啊，门窗玻璃各种硬件等等。由于
屋里还有Washer/dryer，虽然这种概率很小，但如果洗衣机烘干机坏了，难道我还要给
他买新的吗？
2. Attorneys' fees
合约说到，如果遇到纠纷屋主认为有请律师的必要，tenant必须承担所有费用。这个合
理吗？
3.Indemnification
合约说屋主对tenant以及进入屋子的各种人在屋内的任何Damage和injury完全不负责。
这个。。。我从小对吊扇有点杞人忧天，总害怕会掉下来。。。这屋里有两个大吊扇，
万一哪天砸下来砸着我，至少说明设计有问题或者安装不牢或者屋主没有好好检查，也
不用负责吗？
4.Inspection
说屋主可以在任何“reasonable times"进入屋子检查或者进行维修。我觉得这个说的
太模糊了，是不是可以跟他商量写清楚，比如早8点到晚8点，要在我在场的时候，或者
提前一天通知我。

他1月的房租，还有last month rent，一共3个月房租，但是不是1号给的，他9号才收到
但是他都cash了。这一次争端不是房租，是因为他总是把我的东西转移到柜子里面，
我打电话要他不要动了。然后他要terminated，我写了回信。

最容易赶租客走的就是租客老不交房租。就算如此，要去rent board申请批准，流程比
打官司还复杂。
其他嘛，基本上没法赶房客走。就算送那几个非常苛刻的条款请tenant 走，还要给
tenant几万relocation fee.
可惜楼上这位兄弟签的不是lease,是和master tenant 的 agreement,所以没有权益保
障。 |

么确定，尤其是‘lost Rent'还有‘rental commissions’怎么确定？谢！

我的情况是我已经住了两年多了，前2个月才刚刚续签了第三年的lease. 还有10个月
lease才到期，但是我下个月底就要因为工作变动搬到东岸。我之前就跟房东提过有可
能会走，他说“I'll work with you" ，而且他人平时比较nice, 所以我就没放心上，
合同就原样签了。 结果前天跟他提的时候他直接说，给他多交三个月房租berak lease
. 我给了自己一天时间稍微冷静一下做了点research，写了这封信给他。

have.
- Credit check, background check, house maintenance call, verification of
the rental, for example, stop your tenant from growing drug in your house.
Fee -- normal price:
* Monthly management fee 5-10%.
* Finding a tenant (not guaranteed), 0.5 month rent.
* If your tenant come with a real estate agent, another half month's rent.
