引言
在美国从事房地产经营的七八年来，粗略估算，本人所参加过的房地产拍卖会少说也超
过一百次。趁着目前地产市场萧条，“闲着也是闲着”，不如将我经历过的趣闻趣事写
出来与读者分享。以下所述 基本是我的亲身所历。为增加可读性以及避免有人对号入
座，故事中的人和事稍作修改。
我所知道的非自愿转让（Involuntary Alienation）房地产拍卖在本州有如下几种：1.
Sheriff sale (不知道怎么翻译， 由警官主持)；2. 房地产税拍卖 （Property tax
sale）; 3. 取消回赎权拍卖（foreclosure auction），或叫受托人拍卖（trustee
sale）。本人所经历的主要是第3种，以下所有的故事都源于此。
（一）儿戏般的拍卖场地
从书本上知道在取消回赎权拍卖上能买到很好价格的房地产后， 就很想到现场见识一
下。经过几番打听，得知拍卖会每个礼拜五的上午在本县法院大楼进行。回想起在电视
上看到的拍卖会情景，个个与会者都是衣冠楚楚 ，正襟危坐，待到那拍卖官手持小锤

十几年前，在国内某个杂志（忘记是“读者”还是什么）翻到一段翻译的培根“论读书
”。翻译的文字很好（没记下是谁翻译），语言生动，精炼，有深度而又高度概括，很
受启发，当时就把它抄下来。由于语言的精彩，我当时就把它背下来（就像碰到喜欢的
唐诗宋词，甚至长长的散文，包括中英文的格言警句，我都会背下来。这习惯从我小学
开始一直到现在没改，成了我生活乐趣的一部分）。它从未在我的脑海中消失过，就像
其它我背下来的文字一样。不过，为了对读者负责，引用之前，我还是对了我的笔记。

fell to 150,864 last month, a 7% decline from the previous month and a 28%

mortgage）.但是一般买房的时候都会签两个文件一个是mortgage(抵押证明)，一个是
promissory note(相当于借据)。Foreclosure只会抹掉mortgage(抵押证明)，note还仍
然存在，第二个lender还是可以向owner根据note追回贷款。一般大家说foreclosure了
第二个loan的holder 一分钱也拿不到，是因为对于借房贷的，房子一般是他最有价值
的财产，如果还不起房贷了，可能也没什麽其他值钱的财产了，所以第二个lender就算还有
note可能还是追不回什末钱（因为note是没有抵押的）；另外foreclosure的房子卖出
的价格，一般也就是第一个mortgage的balance,或者低于第一个mortgage的balance，
这样的情况当然第二个lender从foreclosure里拿不到任何钱。如果foreclosure的房子

抓出来的。
对于为什么你需要交钱才能去某些网站上看完整的foreclosure list，我的理解是这样
子的——这些foreclosure/short sale的房子，有很多都是非常好的投资机会，所有会
有大把的房地产投资者盯着。有些房子出来以后，可能一两天就会卖掉；而不同的网站
，从MLS里面抓listing的延时是不同的。那些zip reality之类的免费网站，可能延时
比较长，很多foreclosure的房子在能够出现在那上头之前就已经走了。——从这个角
度而言，你说出现在ziprealty不是非常好卖（也就是不会list出来一两天之内就有人
冲上去下offer），也是有道理的。
我LG业余做中介，所以我们总是可以第一时间看到那些foreclosure的房子，也经常会
看到一个foreclosure的房子，价值十万的只标一两万，然后几天之内就没了的情况。
如果是第一次或者第二次买房子、目的只是给自己住的欠缺经验的买家，是肯定抢不过

BTW, 现在的short sale貌似比以前多太多了，redfin上list的那些得有60%是short sale了，偶尔一个regular sale搞得像熊猫一样，要在广告上大叫：not a short sale，etc。呵呵 |

搜索，密密麻麻的都是foreclosure房。今天又看了一下，现在foreclosure的房子已经

released it's mid-year foreclosure report. While the most recent 6-month
time period shows a 5% decrease from the last half of 2009 - compared to
the same time-period last year, foreclosure filings are up by 8%.

这段时间对foreclosure auction 的某一个房子挺感兴趣，位置对我们很合适，房子外
表看着不错，挺新的，趴在窗口看了一下，没有看见什么破坏的东西，社区也好。
目前知道foreclosure auction 的情况是，拍完一个月以后才可以进去，预先要交10%
的押金等，应该也可以承受。
目前最关心的问题是，交了房子钱，还有没有其他要交钱的地方。比如，上面有没有
lien，在foreclosure的时候，是不是这些lien就自动去掉了？
另外，有人建议请个律师，但不知道这种情况下，律师起什么作用。
不知道有谁对foreclosure auction的房子有了解，能不能说一说注意事项等。 |

整个Foreclosure过程有三个阶段：
第一阶段称为Pre-foreclosure
房主只要拖欠一次贷款，银行就可在法院备案，发出欠款通知 (Notice of
Delinquent)警告房主。经过三至六个月，房主仍拖欠贷款，银行就会发出违约通知
NOD(Notice of Default)。
第二阶段称为Foreclosure
在发出违约通知 (Notice of Default) 二个月后，房主既没有卖掉房子又还不出
贷款，银行就会发出拍卖通知 (TrustDeed Sale). 一般在通知发出２１天后进行公开
拍卖。既是在法院拍卖，买者必须用现金来买,不能贷款,而且没有产权保险。在目前的

foreclosure/short sale的listing只有在专门交钱的网站上才能看得到. 这是为什么
呢? 是不是这些list在Ziprealty上的foreclosure的房子比较滞销,所以才拿到这些
free的网站(例如Ziprealty)上促销呢? 换句话说,是不是这些登在ziprealty上的房子
都不好? |

只卖坏区的,所以坏区跌得特别快. 现在房市转暖, 银行渐渐把好区的foreclosure
拿出来卖了, 结果neighborhood自己卖房的人惨死了, 房价需要跟foreclosure看齐,

总能有我不小心掺和一把儿，裹点乱出来。
几个月前，Newton有一个原来值五十多万的房子foreclosure成了三十几万。我领着客
人摸黑跑去看热闹。不想门前的锁头可以当古董，是我出道时就被淘汰的那种，我当年
左右左的几圈转下来，早就晕乎了。为此，没少挨俺师傅的白眼。转不开只好打电话给
Listing Agent，问先向左向右的顺序，她责问我“大晚上黑灯瞎火，跑去干什么？屋
里坏疲梯又被愤怒的房主砸坏?..”让我等天亮再说。

过去，其实Listing Agent手里当天就收了三个offer。我想银行下班了，先报名参战再

总能有我不小心掺和一把儿，裹点乱出来。
几个月前，Newton有一个原来值五十多万的房子foreclosure成了三十几万。我领着客
人摸黑跑去看热闹。不想门前的锁头可以当古董，是我出道时就被淘汰的那种，我当年
左右左的几圈转下来，早就晕乎了。为此，没少挨俺师傅的白眼。转不开只好打电话给
Listing Agent，问先向左向右的顺序，她责问我“大晚上黑灯瞎火，跑去干什么？屋
里没灯ヌ萦直环吲姆恐髟一盗?..”让我等天亮再说。
在Needam也看过一处foreclosure，穿过齐腰深的蒿草，自己觉得非常敬业，感动了一
把，不想一进屋就退缩了。Listing Agent指着地上高低起伏的地毯对我说，要自己承
担后果，如果我从一楼不小心迫降到地下室。我和客人面面相觑，望风而逃。
话说上周四N区出来一个Foreclosure的房子，我还自以为腿脚够快，周五下午带客人赶
过去，其实Listing Agent手里当天就收了三个offer。我想银行下班了，先报名参战再

foreclosure doesn't need agent, you go auction to bid it,then pay with cash.
usually agent won't do it, b/c low commission. but if you find some one who
willing to shop foreclosure for you, please PM me one. thx |

foreclosure 四千多，pre-foreclosure中好学区相对比例明显增加很多，但绝对数量
还是不大，比方说cupertino foreclosure是７个，但pre的有２９个。
全国看来，传说中房价已经稳定的ＤＣ pre数量已经很低，随便看了texas数县也已经
没有几个pre, 但加州整体pre数量还是有蒸蒸日上的趋势。 |

发帖数: 404 | 48 这个不一样的吧。foreclosure不是提前偿还的意思，而是贷款人不按协议每月支付一
笔费用，所以银行可以申请permimssion收回/拍卖贷款人的抵押品。大概这个过程是不
可逆的，所以才叫取消抵押品赎回权。
